Presidential Statement Pledges to Make Annual Declarations of Assets

Office of President Matan Ruak issued a Presidential statement this afternoon on the matter of his declaration of personal assets:  Full text in Tetun, Portuguese and English below.

Meu querido povo de Timor-Leste,

Em 20 de Maio de 2012, tomei posse do cargo de Chefe de Estado da República Democrática de Timor- Leste.

Foi um momento em que você, o povo de Timor-Leste, confiou-me com poderes e privilégios para lhe servir. E com esses poderes e privilégios vêm com a maior e mais sério de responsabilidades.

Uma parte de minhas responsabilidades é que cumpra as promessas de minha campanha eleitoral. Um deles foi que eu tentar definir um exemplo de limpas e auto-disciplinados política em Timor-Leste.

A corrupção é lenta e insidiosamente infectando a nossa sociedade. Isso prejudica o nosso caráter moral e enfraquece as nossas instituições. Em uma época em que precisamos de mostrar disciplina para alcançar os objetivos nacionais de desenvolvimento não existe ameaça maior para nossos objetivos nacionais do que a busca da corrupção no interesse próprio.

Como Presidente, estou fazer uma declaração total e completa de meus bens pessoais totalmente público.

Faço isso para que o nosso povo possem saber quais os bens pessoais que possuo durante a minha Presidência e comprometo-me a fazer declarações anuais de activos até ao final do meu mandato. Faço isso para cumprir a minha promessa de levar por exemplo em nossa luta contra a corrupção.

O Gabinete do Presidente é um instituição público, que me têm sido confiadas com a executar um papel constitucional que é crítico para o funcionamento do Estado. O Instituição não é uma ferramenta para o meu enriquecimento pessoal.

Ao fazer esta declaração de meus bens pessoais e por meio de declarações anuais que devem, de acordo com as minhas responsabilidades de todos os cidadãos e a República Democrática de Timor-Leste, demonstrar que eu não e não vai usar a minha posição a enriquecer-me e a prática desses comportamentos corruptos.

No mato, falámos de um Timor livre da corrupção dos outros que vieram a regra sobre nós. Muitos timorenses derramaram seu sangue para este sonho.

Não podemos esquecer dos ideais patrióticos que nos guiou no passado. Eles agora são consumidos pelo vírus da corrupção.

Faço um apelo a todos os membros do governo, do parlamento nacional, os tribunais e todos os funcionários públicos a unir-se a mim a presente declaração plena e completa de bens pessoais anualmente.

Vamos todos ficar firmemente nesta luta para fazer um forte, livre e próspero Timor-Leste. Aqueles que optarem por não aderir a esta luta contra a corrupção devem perguntar a si mesmos se estão realmente aptos para serviço público. “E o povo de Timor-Leste que servimos todos os dias, são o juiz verdadeiro da credibilidade das pessoas em cargos públicos e no final o povo tomar a decisão final de nossos destinos.

My beloved People of Timor-Leste,

On 20 May 2012, I was sworn in as the Head State of the Democratic Republic of Timor-Leste.

It was a moment when you, the people of Timor-Leste, entrusted me with powers and privileges to serve you. And with these powers and privileges come with the highest and most serious of responsibilities.
Part of my responsibilities is that I fulfill the promises of my election campaign. One of these was that I seek to set an example of clean and self-disciplined politics in Timor-Leste.

Corruption is slowly and insidiously infecting our society. It undermines our moral character and weakens our institutions. In an era when we need to show discipline to achieve the national development goals there is no greater threat to our national objectives than the pursuit of corruption in the interest oneself.

As President, I am making a full and complete declaration of my personal assets totally public.

I do this so that people can know what personal assets I hold during my Presidency and I pledge to make annual declarations of assets until the end of my term in Office. I do this to fulfill my pledge to lead by example in our fight against corruption.

The Office of the President is a public office that I have been entrusted with to perform a constitutional role that is critical to the functioning of the State. The Office is not a tool for my own personal enrichment.

By making this declaration of my personal assets and through annual declarations I shall, in accordance with my responsibilities to all citizens and the Democratic Republic of Timor-Leste, demonstrate that I do not and will not use my position to enrich myself and to practise such corrupt behaviour.

In the jungle we used to talk of a Timor-Leste free of the corruption of others who have come to rule over us. Many Timorese shed their blood for this dream. We must not forget the patriotic ideals that guided us in the past. They are now consumed by the virus of corruption.

I call upon all members of government, national parliament, the courts and all public officials to join with me to present full and complete declaration of personal assets annually.

Let us all stand firmly in this fight to make a strong, free and prosperous Timor-Leste. Those who choose not to join in this struggle against corruption should ask themselves if they are truly fit for public office. It is the people of Timor-Leste, whom we serve every day, are the true judge of the credibility of those in public office and in the end our people make the final decision of our fates.

Parliamentary Commission of Inquiry Detects Virus Eating Up Public Money Parliamentarians Request Minister’s Name Be Deleted From Report

On 8 August 2007 when the President of the republic Jose Ramos Horta inaugurated the AMP government and swore in Kay Rala Xanana Gusmao, formerly President during the previous FRETILIN government as Prime Minister of the AMP, the head of government began to encounter problems with food shortages.

Although this problem did not result in a famine crisis, it nonetheless challenged the political determination of the government. Because of this the government, through its head of government decided to opt for signing contracts with a group of Dili based companies to supply rice to the state of Timor-Leste.  But the process in signing the contracts became complicated because the contracts were signed prior to the National Parliament’s approval of the Rectified Budget. Even worse is that the companies in signing rice supply contracts with some companies breached procurement laws, which covered the contracts and began to betray the trust of the Prime Minister who had thought of these contractors as development partners.

In its 50 page report the Parliamentary Commission of Inquiry (PCI) reported that though at first the head of government is not implicated as having breached the law but his actions may come to be seen as having put his credibility at risk, because these companies with whom the Prime Minister signed the contracts have to date not paid their taxes, and there are indications of manipulation of the price of rice which affects public funds.

The PCI was able to deduce that from the time of the transitional budget in 2007 until 17 September 2009 the state of Timor-Leste had spent a total of US$89,701,783 to acquire 155,150 tons of rice supplies.

The PCI report deduced that during the July to December 2007 budget period, the government spent public moneys totaling US$5,018,746 to acquire 13,225 tons of rice. The PCI formed the opinion that from 2008 to 2009, the government spent a total of US$83,783,032 to acquire 141,925 tons of rice. According to details provided by the government, to 10 December 2009 the government rice stocks totaled 26,100,225 tons in state controlled as well as private warehouses.

The PCI uncovered information that since the government began implementing the policy of intervention in the rice market by selling rice directly to the Timor-Leste public, according to the government’s own estimates for 2008, the return from sales of rice by the government were US$18,038,000 and for 2009 were US$25,000,000, but at the start of December 2009 when the general budget of the state for 2010 was being debated in the national parliament, it was only US$21,500,000 for 2009.

The report also said that the PCI was unable to reach any conclusions regarding the reported loss of 4,000 sacks of rice, which according to explanations from witnesses from the Ministry of Tourism, Commerce and Industry was still under investigation by the Timor-Leste National Police.

A number of Members of Parliament did not sign the report, including Carmelita Caetano Moniz, Hermes da Rosa Correia Barros, who insisted in writing “the report should not state that the Minister’s wife supplied rice.  It should say Ms Kathlyn”. Two other MPs, Domingos da Costa and Teresa Maria de Carvalho also did not sign the report.

The report numbered: 24/CPI.II/XII/2009 dated 9 March 2009 was signed by the President of the Commission Arsenio Paixao Bano along with other MPs; Cornelio da Conceicao Gama, Jose Teixeira, Jacob Xavier, Aicha B. Umar Bassarewan, Domingos Mesquita and Duarte Nunes.

The PCI concluded that the conduct which the government entered into with the company United Food Lda, and signed by the wife of the Minister for Development, Mr. Joao Goncalves, as the 50% shareholder of the share capital holding of the company holding and a director of the company, was in breach of article 3 of Parliamentary Law No. 7/2007.

It further states that according to documents provided by the government regarding contracts signed by it with companies to supply rice to the state of Timor-Leste and which the PCI was able to analyze in detail, during the 2007 transitional budget periods between July and December, the government spent US$6,018,746 to buy 13,225 tons of rice from the company star King Lda, the PCI was able to ascertain information of payments of US$1,464,075 for a total quantity of 3,615 tons of rice at a price of US$400 per ton.

This payment was made by the government on 17/03/2008 and on 21/04/2008, but the PCI was unable to find contract documentation or detailed information regarding the contract signed with the company Star King to justify the information provided from the Treasury of the state.

Insufficient information made it difficult for the PCI to conclude what the contractual obligations and rights were in pursuant to the law or of the conditions laid down in the contract, especially as regards the obligation to pay taxes to the state of Timor-Leste.

But, the PCI was able to find general information regarding payments made by the government to the company People Food for the total of US$1,600,000 based on a price of US$400 per ton.  This payment was made on 27/1/2008 and 27/5/2008 for a total amount of rice supplied of 4,000 tons.

However, the PCI was unable to obtain other information to reach any conclusions regarding how the government entered into these contracts with People Food, so the PCI was unable to rectify the information provided by the Treasury of the state.

Beyond this, the PCI was also only able to find information regarding the payment made by the government to the company Oriental Food for the total amount of US$1,116,000 to purchase 2,790 tons of rice at the price of US$4000 per ton.  This payment was made on 1/2/2008, but the PCI was unable to find other information to further analyze this payment, so the PCI was unable to verify the information from the Treasury of the state.

The PCI found information regarding payment made by the government to the company Nabilan Food in the amount of US$1,131,000 to purchase 2,820 tons of rice, at the price of US$400 per ton.  The payments were made on 25/1/2008 and 12/2/2008.  However the PCI did not find other information to be able to verify the payment or the contract the government entered into with Nabilan Food, so the PCI was unable to verify the information from the Treasury of the state.

The PCI obtained information and some documents provided by the government regarding rice supplies purchased by the government through a contract entered into between the Ministry of Social Solidarity and the company Maubara Fitun LDA for a total amount of US$899,360 for 1,168 tons of rice at US$770 per ton.  The PCI also received some documents from the government like Payment Request, Receiving and Inspection Reports and other information.

Beyond this the PCI also obtained some information from the government regarding a contract entered into between the government and the company Timor Food to purchase rice totaling 2,500 tons at a price of US$350 per ton, for a total sum of US$874,398.

On another matter the PCI was able to analyze public contract documentation that the government entered into with the company Tres Amigos, before the National Parliament approved the Rectified General budget of the State 2008.

From the contract documents obtained by the PCI it was able to conclude that prior to the National Parliament approved the Rectified Budget of the State for 2008, the government had already entered into a contract with the company Tres Amigos for a total of US$14,400,000, despite the National Parliament having only approved and amount of US$4,080,000 to buy 8,000 tons of rice at a price of US$510 per ton in the Rectified Budget of the State for 2008.  However, the contract was later amended and increased to US$14,400,000 to acquire 16,000 tons of rice at a price of US$900 per ton.

The PCI also wrote in its report that the contract the government entered into on 22/10/2008 was not in compliance with the general rules and procedures stipulated in the Decree Law on the Legal Regime on Procurement No. 10/2005, and the Decree law 11/2005 Regarding Administrative Infractions of the Legal Regime on Procurement and the Legal regime on Public Contracts, as well as other laws binding the state of Timor-Leste, including National Parliament Law No. 7/2007 of 25 July 2007 on the Rights and Obligations of Officeholders of Constitutional Bodies.

Meanwhile regarding the contract the government entered into with the company United Food Lda, the PCI concluded that the contract with the wife of the Minister for Development as director and shareholder of 50% of the shareholding of the company United Food Lda breached article 3 of National Parliament Law No. 7/2007.

The PCI also concluded that the company United Food breached chapter IV, article 32 of the Decree Law on the Legal Regime on Public Contracts No.11/2005, regarding contractual warranties, and that it breached clause 21 of the Contract’s General Conditions of Contracts for Supply of Goods and Related Services regarding the payment of Taxes and Charges.  It is stipulated in clause 21.1 that “The Supplier shall be entirely responsible for taxes and charges levied by the state and its duly constituted authorities.”  To this date the company United Food Lda has not paid taxes to the state of Timor-Leste in breach of the above mentioned terms.

In addition, the contract for supply of rice entered into by the government with the companies Belun Feto, Atramor Success Supply, Star King Unipessoal Lda, and Maubara Fitun Unipessoal Lda, whereby each company was awarded a contract valued at US$3,842,5000 to buy 7,250 tons at a price of US$530 per ton, breached article 32 of the Decree Law on the Legal Regime for Public Contracts regarding Contractual Warranties, and clause 21 of the Contract’s General Conditions of Contracts for Supply of Goods and Related Services regarding the payment of Taxes and Charges, especially clause 21.1 that states “The Supplier shall be entirely responsible for taxes and charges levied by the state and its duly constituted authorities.”

Regarding the contract the government signed with the company Serba Jaya Makmur, which was signed by the Prime Minister Kay Rala Xanana Gusmao with the director of PT Serba Jaya Makmur, Mr. Sudarmado on 27/10/2008 for a total contract price of US$1,615,000 for 1,900 tons of rice at US$850 per ton, the PCI concluded that it did not comply with the government Decree Law on Procurement number 20/2005 because at the time it entered into the contract with PT Serba Jaya Makmur for the supply of rice at a price of US$850 per ton, it had entered into contracts with 6 other companies for the supply of rice at US$530 per ton.

The PCI concluded that there was a loss of US$608,000 to the state of Timor-Leste as a result of the contract the government entered with PT Serba Jaya Makmur in the amount of US$1,615,000 to purchase 1,900 tons at a price of US$850 per ton.

The PCI acknowledged that the government was acting to secure rice supplies for the state of Timor-Leste at a time when the people of Timor-Leste we in need of it.

Due the above the PCI recommended that:

1.        An investigation and audit be held into the entering of the contracts by the government for the period of the 2007 Transitional General Budget of the State with the companies Star King Lda, People Food, Oriental Food and Nabilan Food.

2.        That an investigation and audit be carried out to ascertain whether anyone should be held accountable for the additional payment on the contract entered into through the Ministry of Social Solidarity State General Budget with the company Maubara Fitun Lda for the total amount of US$899,360 to buy 1,168 tons of rice at a price of US$770 per ton.

3.        The PCI recommended an audit of the payment made on the contract the government entered into with the company Timor Food from the Ministry of Solidarity’s General Budget of the State to buy a total of 2,500 tons of rice at a price of US$350 per ton in the total amount of US$874,398, but then which by an invoice from Timor Food dated 28/4/2008, requested to the government that it pay US$874,398.36 for only 2,082 tons of rice based on a price per ton of rice of US$419.98.

4.        The PCI recommended that an audit be carried out to ascertain the principal reason for the difference in the price of US$350 per ton of rice in the contract the government entered into with the company Oriental Food for a total of US$899,360, with the prices of US$770 per ton in the contract with the company Timor Food.

5.        In respect of the contract the government entered into with the company Tres Amigos prior to the approval by the National Parliament of the 2008 General Budget of the State, the PCI recommends that the State Justice institutions investigate the legality and responsibility by the government in allowing an amendment to the contract with Tres Amigos in May 2008 increasing the contract amount from an initial amount of US$4,080,000 to US$14,400,000, which amount was never provided for in the 2008 General Budget of the State.

6.        The PCI recommended that State Justice institutions investigate the contract entered into between the government and the company Timor Food to determine the legality and whether anyone should be held accountable for the agreement which was signed by James Jong  Fu Kong and Epifanio da Silva da Costa Faculto, Director of the National Directorate of Tourism, Commerce and Industry on 14/5/2008 committing the State to a debt of State funds in the amount of US$5,100,000 for rice at US$1,000 per ton.

7.        The PCI requested that the State Justice institutions undertake an investigation to ascertain the legality and whether anyone should be held legally responsible for the tax exemption granted to the export company Kien Giang by the government on 18/8/2008 before the contract was signed with the company Serba Jaya Makmur on 29/8/2008.

8.        With respect to the contract the government entered into with the company United Food, the PCI determined there was a conflict of interest involving Ms. Fon Ha Tchong, Director of United Food and wife of the Minister for Development Mr. Joao Goncalves. The PCIU recommended that the State Justice institutions to undertake an investigation to determine whether anyone should be held legally responsible for the non compliance with article 3, sub articles 1 and 2 of the National Parliament’s Law Number 7/2007 regarding the Rights and Obligations of Officeholders of State Constitutional Bodies.

9.        The PCI recommended that the State Justice Institutions investigate the companies Juxibel Lda, Veterans General Store, Ran Aitana II, Lunarsol Unip Lda, Taci Tolu Holding and Monte Veado to determine whether there any taxes are owing by these companies to the State of Timor-Leste.

10.        The PCI recommended that the State Justice Institutions investigate the company Prima Food to establish whether there was a breach of the National Parliament’s Law Number 7/2007 on the Rights and Obligations of Officeholders of Constitutional Bodies given that Ms. Herguilina F. Alves, the daughter of Ms. Maria Domingas Fernandes Alves, the Minister for Social Solidarity held 11.18% of the shareholding in the company.

11.        The final recommendation from the PCI to the State Justice institutions was for it to investigate the company Hercio International Lda to ascertain with certainty whether the sale by this company on 20/6/2009 to the company Olifante of 777 tons of rice for US$2,999,146, was rice that had already been acquired by Hercio International for the state of Timor-Leste.

12.        Paragraph 10 of the PCI report states that the PCI recommended a thorough investigation as well as an audit be undertaken to establish the exact amount of rice that was sold by the government or how much was lost so that in 2009 it made an estimate of US$21,500,000 as receipts from the sale of rice.  (Ends)

The Government chooses more expensive fuel fattening Sunshine whilst the public loses US$810,000.00.

In the middle of the month of May 2009 the Fourth Constitutional Government was forced to terminate the fuel supply contract to the EDTL by the company Pualaka Petroleu after there was a clash between the three directors.

When the contract with the Company Sunshine ended, the government opened a public tender through its central procurement, which a number of companies competed for in the month of November 2009, and the company Sunshine continued to supply fuel to EDTL.

This tender process took some time, up to the time when the government announced to the public that the company ETO had won the tender. The other companies lodged protests and allegations of Collusion, Corruption and Nepotism emerged as well as concerns of a monopoly being created because the director of ETO is the nephew of the Prime Minister Xanana and he had also been awarded other project tenders by the government at the time.  As a result the government was forced to freeze the tender until now.

Consequently the government extended the contract with the company Sunshine up to 31/01/2010.  For the month of February until now into March it is still the company Sunshine that is supplying fuel to EDTL and the result of the tender is still not known.  As a result the total time duration in which Sunshine has been has now been supplying fuel to EDTL has been nine months with an original six-month contract that was merely extended from the end of December until the end of February.

FRETILIN MP Arsenio Paixao Bano from FRETILIN loudly questioned this contract extension through a telephone interview alleging that, “when a contract is amended but despite the price of fuel falling, they still continue with a higher price then this is theft of public moneys.”

According to invoices from Sunshine Petrol group number 53/SPG/P.O/RDTL dated December 2009 the company Sunshine supplied EDTL with fuel valued at US$00.953 whilst other importing companies like Pertamina sold fuel at between US$00.79 – US$00.80 and Atauro Oil sold fuel at US$00.78 per liter.

A comparison of the price between sunshine and Pertamina results in a difference of US$00.15 (fifteen US cents) and compared with Atauro Oil’s price that shows that the public loses US$00.17 (seventeen US cents) per liter.

This difference in prices shows that for the month of December the state lost US$450,000 that could have been saved and used for some schools instead of being wasted as Bano said.  On Monday last the FRETILIN parliamentary bench in the plenary of the national parliament questioned the condition of a school located at the foot of Mount Matebian, which was in a decrepit condition, insufficient rooms for all the students, in need of teachers, without a room for the staff and yet the state carelessly threw away US$450,000.

He alleged, “public funds were stolen because the price of fuel feel but the government carried on as normal.”  He added to his accusation that, “If the price fell and the government decided to pay the same price they had been paying, then that means stealing from the public purse.”

“If a tender has been held, but the contract is yet to be signed but is merely extended, then why hold the tender in the first place?” Bano questioned.

According to Bano, “this should not happen, this is maladministration. Who will take responsibility for facilitating this contract, these persons who did this are irresponsible, immoral, are not serious or responsible,” alleged Bano.

Arsenio said that on one hand the government spends money without properly calculating what it is spending but on the other hand the peoples’ living conditions is still very poor. “this is throwing money out aimlessly just in order to fatten up a few people,” he accused.

The Vice President of the most voted party who lost the opportunity to govern in 2007, thus becoming the major opposition party said that, “the problem with the government is that they do not have a plan, so they just throw money away aimlessly, just to fatten up some people.  Look at the schools many of which are in a state of disrepair and instead of repairing them they fatten up companies with contracts such as the type Sunshine was given.”

He said that if they calculate their spending properly then they will save a lot of money that they can use to pipe water to communities and fix quite a few schools in Dili and in rural areas including to better a lot of the irrigation schemes that are not currently functioning, instead of looking after companies who sell with a price that causes a lot of concern and doubt,” Bano said.

The MP followed up saying that according to the normal processes you cannot make more than one amendment for the same contract.  He explained that you could amend a contract once after a tender has been held and the winning bidder has been announced.

Responding to the concerns of Mr. Bano, Joao Martins who is the owner of Sunshine said that the government selected his company because of its superior service in the last nine months when it had faced problems with the previous supplier. “The government made this decision and I just followed them because I assumed the government acts in Timor’s interests,” Joao Martins told this newspaper during an interview at Hotel Timor on Thursday, 25 February 2010.

According to the invoice from Sunshine Petrol Group that was signed by its general manger Chian Choon Ning on 24/12/2009, which this newspaper was able to obtain, it was written on the front page and second page that the amount of fuel supplied to EDTL was 1,257,890 liters to generate electricity for 12 days in Dili, whereby the state paid US$1,198,768.17.  “Right now we calculate that more or less EDTL consumes 3.5 million liters per month,” said the Sunshine company proprietor Joao Martins.

Responding to questions regarding the price of Sunshine fuel being more expensive than the others Mr. Martins said, “When we compare the price of fuel we must compare apples with apples.” The reason it is more expensive than other fuel is that, “their (the other companies) fuel is light heavy fuel, or NGIO with 1.5% sulfur or 1% I don’t know, but Sunshine’s fuel is High Speed Diesel fuel with sulfur content 0.05% and this is superior quality from that of those who are claiming that this fuel is more expensively.”

He explained that regarding the price of fuel for the month of December, “If we compare from December till now, the price of fuel pre barrel rose to US$80.00, so for this very reason we have to look at the fact that this fuel comes from a premium refinery that is properly refined and therefore its quality of price is evaluated in this context.”

According to Joao Martins, “at the moment we calculate that EDTL consumes approximately 3.5 million liters per month.

He thanked the government for the confidence they had in him to work together with them in the electricity sector.  “I want to thank the Government for seeking stability in Timor and Sunshine will also makes its own efforts to ensure that the power stays on in Timor,” Joao closed.

According to documents obtained by this newspaper from the Office of the Secretary of State for Electricity, they show that the company Atauro Oil had already sent a quotation price for fuel for January and February 2010 to the relevant office.

“I want to present to you a price quotation for High Speed diesel for the current month of January (2010),” sated the quotation document from Atauro Oil Supply LDA.

This quotation presented a price for the fuel of US$00.77 (seventy seven US cents) per liter and Atauro quoted a price per liter for February of US$00.80.  This compares with the price quoted by Sunshine of US$00.893 per liter for the month of January, which is US$00.12 (twelve US cents) more expensive.

If the government had accepted the January quotation from Atauro it would have saved the public US$360,00.00. The government decision to buy fuel in December 2009 and January 2010 resulted in a total loss of US$810,000.00 to the public.

Atauro oil also presented other documents such as “certificate of quality” from Schutter Far East Sdn Bhd guaranteeing that Atauro Oil would be importing High Speed Diesel.  The director of Atauro Oil Mr. Lorenco declined to make any comments when this newspaper tried to confirm this with him because he did not wish to embroil himself in problems with other companies.

But MP Inacio Moreira condemned strongly the moneys misspent by the state arising from the calculations presented in this article.

“They have to do the mathematics on the funds allocated for fuel acquisition properly; they should not exaggerate the price of fuel; the price fluctuations in the world market should be taken into account.  I see that the company that is presently supplying fuel to the EDTL has an exaggerated price,” alleged Moreira.

“The government should select the company that sells fuel at the lower price so that the state budget benefits instead of buying more expensive fuel simply to enrich a company in which they have friends,” Moreira lamented.

He suspected that, “This was clearly a case of not doing the mathematical calculations but just deciding to go ahead, I suspect that this was intentional.”

The MP suggested that, “the government should have sought quotations from all companies that import fuel so as to evaluate which could supply the cheapest fuel.”

Moreira too said that the price at which Sunshine supplied fuel was “over the top”.  His reasons were that, “the world price fluctuations is usually between 70-80 cents per liter, so why is that the government decided to acquire fuel as high as 95 cents?  This needs to be investigated, as perhaps this did not involve a proper evaluation process but that was simply decided on.  I have my suspicions that this was intentional,” alleged the MP from the FRETILIN parliamentary bench.

“Such conduct that breaches the law or involving ill intent to just hand over benefits to one another cannot be permitted to go on,” said Moreira.

The MP suspects that there are many doubtful issues surrounding the process for supply of fuel.  “One thing for example, Sunshine has some relationship with a member of government; so from our point view it is like handing out favors to one another, with a price that we can see is inflated, because we can all see that the price fluctuation has gone from 70 cents but not beyond 80 cents.”

He said that for some time now the contracts for supplying fuel to EDTL has been given to family of members of the government, so he asks, “that there needs to be control exercised by the government to ensure that the fuel supply contracts are decided on a proper basis.  They should not be allowed to just pass on favors to one another, but there has to be a process according to the law because all Timorese businesses should have the opportunity to compete for these contracts because many have the capacity to fulfill the contracts with the EDTL,” Inacio declared.

EDTL staff also acknowledged that the price of fuel from Sunshine was more expensive and so on the 29th of January 2010 the Director General of EDTL Mac Maidens wrote letter reference number 018/DG/1/10 to Manuel Monteiro, director of Procurement at the Ministry of Finance stating,

According to another document from the Secretary of State for Electricity he acknowledged that fuel from other companies was better than Sunshine’s.

When this newspaper questioned the Secretary of State’s document ref. 10/SE-EAU/1/10 he pretended diplomatically saying, “The tender was not done here, but was done in Central Procurement, so I do not know and you have ask there.”

He explained with a curious face that, “The contract was done in the Ministry of Finance so ask there, because we just wait and receive. When it involves a contract for a large amount they advertise and evaluate, we only send our technical people to sit together to help them decide and we just comply with the decision that is made.”

When this newspaper tried to seek clarification from Francisco Soares he said that, “The issue is not the price, but it depends on the price in the international market which is always fluctuating.”

When asked why they had given the contract to Sunshine again Burlaku argued that, “because they had previously won the tender, that is the reason, they were still contracted because they had been through a process.”

It is interesting though that the shift from Pualaka to Sunshine has been described as a rotation as the director general of Sunshine himself said.

Francisco also explained a little regarding the tender that ETO had already won.  “Just wait for the government’s decision, because the government has not yet decided, so Sunshine will attend to our needs.”  Despite Mac Maidens having already stated that Sunshine’s fuel was more expensive Francisco Soares continued to maintain that it should be Sunshine.  The Secretary of State Januario Pereira has already proposed another company that sells cheaper fuel that will save public funds that are being squandered.

Tempo Semanal sources within the Government of Timor-Leste stated last night that the Council of Ministers will hold an extraordinary and emergency meeting today (Saturday 27 February 2010) to discuss the matter of the soon to arrive FALINTIL-FDTL patrol boats from China.

The Government of Timor-Leste signed a contract for two Shanghai class patrol boats from Poly Technology of the Poly Group in China.  Poly Group, which has close ties to the Chinese People's Liberation Army (PLA), is expected to deliver the patrol boats in the next 4-8 weeks.  However, port facilities are not ready and there is an urgent need to prepare the Hera port for their arrival.  Efforts are already underway to build a port facility for the patrol boats on the south coast of Timor-Leste.

Tempo Semanal sources have raised allegations that Ines Almeida (a dual Australian-Timorese national), formerly adviser to Minister of Finance Emilia Pires (paid for by the Worldbank) until mid 2009, has been aggressively lobbying on behalf of an Australian company to build port temporary facilities in Hera for the patrol boats. It is reported that the boats will be "modified versions of the Type-62 Shanghai-class patrol boat, which was designed in the 1960s: 43 meters long, displacing 175 tons and armed with two 30-mm cannons."

According to Tempo Semanal sources Ms. Almeida and agents of the Company she is lobbying on behalf of recently visited Hera port and requested data specifications on the port from F-FDTL officers.  This was refused and Ms. Almeida allegedly lodge a protest with the Government.
