Timor-Leste Sues ConocoPhillips for Hundreds of Millions, Possibly Billions.

Just 3 days after the national elections, and confident of its future electoral mandate, the Government of Xanana Gusmao has announced that it is launching legal action against US oil and gas company ConocoPhilipps and others.

Timor-Leste's Petroleum Fund of over 11 Billion USD is almost entirely generated by the Bayu Undan project currently being operated by ConocoPhillips.

According to the Government press release from yesterday, Secretary of State for Natural Resources (Alfredo Pires), who is also a member of Xanana's CNRT party, stated that “It is a David and Goliath fight”, said Secretary of State for Natural Resources Alfredo Pires, adding that “hundreds of millions, possibly billions” is owed.

Tempo Semanal sources indicate that the Government is seeking to not only obtain back taxes but also to pressure Conoco into greater cooperation on proposed south coast oil and gas supply base engagement.  The Government also wants to ensure Conoco improve its development local businesses more serious as part of their engagement with Timor-Leste.  Despite claims its website that it engages with local business worldwide it does not do much in Timor-Leste.

Timor-Leste confirms action underway to reclaim taxes

The Democratic Republic of Timor-Leste is engaged in legal action against multinational oil companies Conoco-Phillips and others to recover substantial monies it believes are rightfully owed the people of Timor-Leste under legal obligations stemming from production contracts in the JPDA, Joint Petroleum Development Authority. U.S. Ambassador and lawyer Pierre-Richard Prosper has been engaged to advise and represent the Democratic Republic of Timor-Leste on matters related to the Petroleum sector, investment and infrastructure development. After audits by the relevant authorities in Timor-Leste 28 assessments have been made against oil companies.
Ambassador Prosper confirmed that “as part of that auditing process they (the relevant authorities) are discovering that there are large areas where there were discrepancies”.
“It is a David and Goliath fight”, said Secretary of State for Natural Resources Alfredo Pires, adding that “hundreds of millions, possibly billions” is owed. Under the terms of the JPDA, 90 per-cent of revenue is owned by Timor-Leste while the remaining 10 per cent is due to Australia. Ambassador Prosper urged Australian Taxation Office ATO officials to conduct similar due diligence audits of the revenues paid to it so far.

“I would assume they should be equally interested to find out if the companies are paying the appropriate taxes.”
Timor-Leste believes that in order for full disclosure and harmonization of taxation in the JPDA it remains in the interests of the Australian taxpayer for a taxation sharing Memorandum of Understanding to be signed between both nations. “In order to do the math, in order for Australia to be fully satisfied that taxes have been paid it is important to know what has, and what has not been paid, because you need the numbers to add up. In other words, there is a piece of the equation that is missing for both Timor and Australia and it makes sense that a tax authority, be it in Australia or Timor, would want to have that complete in order to come to a conclusion as to whether or not all taxes have been paid,” said Ambassador Prosper.

Mindful of the current debate in Australia about illegal migration, Ambassador Prosper re-iterated the Timor-Leste government view that there are strategic benefits for Australia in securing the economic future of its near neighbor. A key policy position of the Timor-Leste government is that a pipeline bring oil and gas from the Greater Sunrise field onshore Timor-Leste, to boost the jobs and opportunity in the country.
“We do not want to have a situation where there is a country to the north that is unstable,” said Ambassador Prosper, adding, “you want a country to the north that is a partner in trade, a partner in peace, so that you do not have chaos and migration issues that often sometimes plague this part of the world. “ENDS

Digicel Wins License, But Set to Pull Out of Timor-Leste


Digicel first arrived in Timor-Leste in 2008 and established offices in Dili in 2009.  It came to Timor-Leste in search of a license to operate a national telephone and internet service to compete with the much criticized monopoly held by Timor Telcom.

After 4 years of relationship building, investing in community services, learning about Timor-Leste and making preparations in every district for a possible license, Digicel was granted a license on 28 June 2012.  Digicel claimed that if awarded a license that it would invest 100 million USD into Timor-Leste.  However it was not the only other company to win, as Indonesian company TELIN was also awarded a license.

Tempo Semanal sources have informed this newspaper that despite winning a license, DIGICEL intends to withdraw from the the country, and end its business aspirations in Asia's newest country.


When Tempo Semanal called Tiago Guerra CEO of Digicel Timor-Leste on 10 July he said, " I provide any further comment only that the Director of DIGICEL has left Timor-Leste and we expect to come out with a joint statement with the Government of Timor-Leste."

The Government's press release on the license award stated that:

"The Ministry of Infrastructure received four applications for the two new licences. The highlights of the successful applications are as follows:
  • Digicel commits to launch GSM mobile telephone and high speed 3G Internet access covering over 91% of the population within 4 months. Its strong operational readiness, including familiarity with the Timor-Leste market and well developed network plans, positions it well to roll out information and communications technology (ICT) services rapidly across the country. Digicel brings to the Timor-Leste population its vast experience and success competing in over 30 small island developing economies.
  • Telin promises to commence services within less than 6 months and commits ultimately to reach 94% of the population with GSM mobile telephone and high speed 3G Internet access. A substantial performance bond and support from mobile operator Telkomcel, its sister company in the Telkom Indonesia group, back up Telin’s operational readiness and commitments. Its large financial scale and geographic proximity put it in good standing to sustain the development of its business in a competitive market.
Competition among Digicel, Telin and the incumbent operator Timor Telecom will deliver extensive benefits to the population and business community of Timor-Leste, particularly in terms of pricing, quality, variety and coverage of ICT services."


"PT Telekomunikasi Indonesia International or further called as “Telin” are one of the subsidiaries of PT Telekomunikasi Indonesia Tbk. (Telkom) an Indonesia’s largest telecommunication and network provider. Telin’s focus is as an international carrier services and strategic investment in international telecommunication business serves as Telkom’s business arms in managing and developing its business lines abroad. Telin manages several subsidiaries, namely AriaWest International Finance BV in Amsterdam that focuses on financial sector, Telekomunikasi Indonesia International Pte. Ltd. in Singapore (Telin Singapore) and Telekomunikasi Indonesia International (Hongkong) Limited (Telin Hong Kong) that just started to operate in the end of 2010. The two-telecommunication subsidiaries will serve function as our main gateways to international telecommunication market. In addition to those subsidiaries, Telin dominates 29.71% shares of the Scicom (MSC) Berhad Malaysia, the largest contact center for outsourcing service providers in Malaysia."

Tempo Semanal sources suggest that DIGICEL did not see competitive advantage or commercial opportunity in a market place with three operators, especially when one is a company linked to Indonesia's largest telcom operator.

Timor-Leste is possibly set to have phone service provided by a company from Indonesia and another from Portugal.  When asked by Tempo Semanal, sources in civil society and Government questioned how wise it is to be increasingly dependent on Indonesia for the provision of critical infrastructure and services.  Currently air routes are dominated by Indonesian carriers, 99% of fuel is imported from Indonesia, as most goods.  Now it appears though critical telecommunications services could end up dominated by a company linked to Telkomsel.

A student named Fransisco Maia at National University of Timor-Leste asked, "Are we to become an economic colony of Indonesia?"

ALKATIRI SEEKS TRANSITIONAL COUNCIL FOR OLD GENERATION AND FRETILIN SEEKING COALITION WITH CNRT


Despite making claims that FRETILIN would win an outright majority on the recent 7 July national election Mari Alkatiri Secretary General Of FRETILIN is now dealing with a different reality.

According to a senior FRETILIN leader is told TEMPO SEMANAL that FRETILIN has been trying for two days to gain access to the Xanana Gusmao, President of CNRT which got the most votes.  This source has informed Tempo Semanal that FRETILIN is trying to open a discussion about how FRETILIN can make a coalition government with CNRT.

FRETILIN seeking coalition so as to gain access to legislative powers to help change the constitution and pass a number of laws.

While Xanana’s allies the PD and Frente Mudanca party leadership have already met with Xanana the day after the election, FRETILIN remains locked out. PD and Frente Mudanca are old allies of Xanana in the previous AMP government. According to some analysts PD and Frente Mudanca have more chance at forming a coalition with Xanana’s CNRT to establish a new coalition Government.  This is due to the fact that FRETILIN and Alkatiri have long opposed Xanana’s Strategic Development plan. But according to Tempo Semanal sources within FRETILIN the party's leadership is now looking to push Alkatiri to agree with Xanana's Development plan. 

While FRETILIN has increased is Parliamentary seats from 21 to 24 Xanana’s CNRT party has increased more to a total of 30 seats and has moved from second most voted party in 2007 to first most voted party in 2012. 

The following is an exclusive interview between Tempo Semanal and Mari Alkatiri conducted on 9 July 2012.

TS: During the FRETILIN campaign for the parliamentary elections you repeatedly called for an end to attacks on XANANA GUSMAO, why has your party changed its policy?

MA. We did not really call for an end on criticism of XANANA. But I do believe that the leaders of our generation need to hand over power to the next generation. We should not just hand over power but also show a good example to the next generation. We need to show a good example, in order to think about the way forward. Sooner or later we have to hand political power and leadership to the new generation. Not only goodwill. It’s not enough. But we need to set a good example. It is about the day-to-day life of practicing politics, and not just about attacking each other as enemies. We are not enemies. Of course we not think in the same way.  This is part of the democracy.  We have to think about the interest of the people and the interest of the nation.

TS: Is this a new maneuver to save your party?

MA:  I am not speaking on behalf of the party. But we came from the same roots and with the same beliefs.  And we have the same objectives. This is the point. Parties are important for our democracy.  But we need to think of the future of the nation, in such a way we can really free the people from poverty.  Our new cause is how to combat poverty and free the people from poverty. I think we (1974 generation) are not more than three to five people. We really need to hand over everything to the new generation.

TS: Do you mean the 1974-generation like Ramos HORTA and XANANA?

MA: Yes. Ramos HORTA and myself are the founders of this nation.  The other founders have passed away recently.  He is Francisco Xavier do AMARAL. XANANA GUSMAO is a person whom since 1979 to 1999 led the resistance until the end of our struggle.  Of course he joined FRETILIN in 1975, and he lead the resistance for more then 20 years. It is s very important to have this generation from 1974 and 1975 to be able to think about the future of the nation without us.

TS: Do you mean you are seeking a coalition between the leadership of the older generation?

MA: I am not looking for a coalition to lead the government. But I am looking for a coalition of good ideas and good will. I am looking for a coalition of objectives or targets.

TS: Is there any response from Mr. XANANA to your proposal? If not what are you going to do to convince XANANA to accept your offer?

MA:  I will keep repeating my appeal. Of course I think XANANA is a person of good will. He is also a dreamer for the best of our people. And I do still believe that immediately after the election we will sit together and try to think about it.

TS: If the 1974 and 1975 generation can’t accept your idea what would be the consequences to the founders of this nation?

MA:  It means we fail. This is really a failure from our side.  And then soon or later our people will reject us.

TS: People are discussing the possibility of coalition between FRETILIN and CNRT in time to prevent the history of 2007. But some do not believe that FRETILIN and CNRT will be able to sit in the same table of council ministers. What are your feelings on this?

MA: I think we can’t really make this kind of equation of the historic leaders to be away from a political power and to support or assist those one going to govern the country.  It’s not easy for us to have coalition with every political party.  But one thing has to be respected.  The winner has to lead the coalition and not the second place party. This is the point if we are to respect the will of the people.  The winner is to lead a coalition.

TS: How to prevent the 2007 scenario which FRETILIN was not able make a coalition with any party and the President invited the second most voted party which able to form a coalition to establish a Government. People are arguing that the constitution is vague and there is no time frame set so as to allow people to interpret it according to their own way. What’s your interpretation?

MA:  For me my interpretation of the constitutions is clear. The most voted party has to be invited by the President of the Republic to lead the government. If it fails to be able to create a coalition then the President has the opportunity to invite others or the second most voted party to do so.  But the President cannot choose the second most voted party before allowing the first most voted the opportunity to establish a coaltion.

TS: So what happened in 2007 was that FRETILIN as the first most voted party was not given the chance to form the government but President called in the second most voted party which was able to form a coalition for government in that time.

MA: Yes.  It was unconstitutional.

Paranoid Politik Terhadap Taur Matan Ruak

Pemilihan Umum (pemilu) tinggal dua bulan lagi, sehingga membuat para konstestan dan kelompok-kolompok kepentingan (interest groups) mulai melakukan aksinya. Berbagai estrategi dirancang, mulai dari lobi politik, kritik sampai negative campaign. Tujuannya mengarah pada dua hal, pertama, menarik simpati massa sejak dini guna membangun opini (opinion building) bagi kelompoknya untuk menghadapi pemilu. Kedua, menabur hambatan dari sekarang bagi calon pesaing di pemilu nanti.

Mayor Jenderal Taur Matan Ruak yang berlatar belakang militer menjadi target utama lawan politiknya. Popularitas Taur Matan Ruak dikenal oleh berbagai kalangan masyarakat . oleh karenanya, menjadi penting bagi lawan politik untuk mendekonstruksi bangunan popularaitas Taur Matan Ruak sehingga mengurangi simpati konstituen nantinya.

Dengan demikian lawan politik manapun mencari berbagai celah untuk dijadikan sasaran kritik bagi Taur Matan Ruak. Kritik yang sentar didengar berhubung dengan latar belakangnya sebagai seorang militer yang dihubungkan dengan pernyataan Taur Matan Ruak diberbagai media nasioanal yang dinilai bahwa Taur Matan Ruak cenderung otoriter bila menjabat sebagai presiden Republik Demokratik Timor Leste (RDTL) nanti.

Kekahwatira berbagai pihak akan munculnya otoritarianisme baru dan desain institusi setelah melihat Taur yang berpangkat Mayor Jenderal secara resmi mengumumkan pencalonan dirinya sebagai calon predien (capres) Independen untuk periode 2012 - 2017 pada tanggal 10 Oktober 2011 di Mertuto, Ermera. Kekahwatiran lawan politik/politisi dan pengamat karena Taur berlatar belakang militer ikut serta dalam pilpres 2012, dianggap berbagai pihak cukup rasional. Tampaknya di kepala para politisi dan pengamat Timor-Leste berkembang sebuah asosiasi bahwa latar belakang militer identik dengan otoritarianisme (ditadura).

Hal itu bisa dimengerti meski tidak sepenuhnya benar, mengingat selama 24 tahun (1975-1999) Timor-Leste di bawah otoritarianisme Suharto yang berlatar belakang militer. Namun, kenyataan yang terjadi otoritarianisme tidak hanya muncul dari orang yang berlatar belakang militer namun bisa dari sipil. Indonesia pernah dibawa otoritarianisme Ir. Soekarno selama dua puluh tiga (23) tahun, pemimpin yang berlatar belakang sipil. Begitu juga Iraq, selama tiga puluh (30) tahun Iraq hidup dibawa otoritarianisme Saddam Hussein yang memiliki latar belakang sipil dengan partai Baath sebuah partai sosialis di Iraq.

Artinya orang yang berlatar belakang sipil juga dapat menjadi otoriter dan yang berlatar belakang militer bisa menjadi sipil. Di Amerika Serikat, seorang Jenderal bisa berubah menjadi sipil ketika menjadi presiden begitu juga Jenderal Susilo Bambang Yudhoyono (SBY) ketika menjadi Presiden ia benar-benar menjadi sipil.

Jadi latar belakang dari calon presiden bukan satu-satunya faktor penentu apakah Timor-Leste akan terjerumus ke sistem otoriter atau tidak. Selain pribadi capres, yang juga menentukan apakah sebuah Negara mudah terperosok kedalam otoritarian atau tidak, adalah desain institusi di Negara itu.
Desain institusi Negara Timor-Leste, yakini jenis sistem pemerintahan yang diterapkan dan pengaturan  Sistem Semi Presidensial dalam konstitusi. Keyakinan sebagai ilmuwan politik bahwa sistem Semi Presidensialisme sulit untuk melahirkan sistem otoritarianisme, karena Presiden hanya sebagai simbol seremonial. Meskipun Presiden sebagai Panglima Tertinggi Angkatan Bersenjata FALENTIL-Forsa Defesa Timor Losete (F-FDTL) namun Presiden tidak leluasa dalam mengambil keputusan tentang masalah pertahanan dan keamanan.

Seperti mengumumkan keadaan perang atau keadaan darurat, pengumuman tersebut mesti dengan persetujuan Parlemen Nasional setelah berkonsultasi dengan Dewan Negara (Konsellu Estadu), Pemerintah dan Dewan Tinggi Pertahanan dan Keamanan (konsellu superior defesa seguransa). Karena dalam sistem pemerintahan semi presidensial, fungsi kepala Negara dipengang presiden dan fungsi kepala pemerintah ada ditangan Perdana Menteri. Berbeda dengan sistem presidensial, kedua fungsi itu dipegang presiden.

Jadi menurut saya, sistem presidensialisme yang cenderung melahirkan otoritarianisme. Karena beberapa ciri khas sistem presidensialisme, seperti konsentrasi kekuasaan yang ada pada presiden, pemilihan langsung presiden dan masa jabatan presiden yang pasti.

Faktor konsentrasi kekuasaan yang membuat posisi presiden amat kuat. Jika dibandingkan dengan sistem semi presidensial. Presiden dalam presidensialisme memancarkan aura kekuasaan amat terang karena dialah yang memimpin ritual kenegaraan  dan mengendalikan pemerintahan. Seorang persiden bagaikan “raja” dalam bunkusan sistem politik modern.

Jadi intinya, kekahwatiran bahwa personalitas individu capres merupakan faktor terpentingnya untuk menilai seberapa besar peluang Timor Leste menuju ke sistem politik otoriter tidak sepenuhnya akurat. Faktor desain institusional yang diterapkan juga memberikan kontribusi yang sama besarnya dengan faktor personalitas capres.

Namun ada politisi yang bereaksi secara negatif bahkan berlebihan. Sejumlah politisi dan pengamat memperlihatkan "kecemasan yang terlampau tinggi" terhadap figur militer. Seakan sulit membedakan "sikap militer" dan “Sipil”, para kritisi tersebut terus-menerus memompa semacam "fobia militer” kecemasan dan ketakutan berlebihan terhadap figur Taur Matan Ruak yang berlatar belakang militer.

Saya cenderung menyebut sikap kecemasan yang mungkin juga menjurus ke arah sejenis antipati ini sebagai gejala "paranoid politik" terhadap Taur Matan Ruak. Mereka mengidentikkan Taur Matan Ruak semata-mata dengan “otoriter, represif, diktator". Idealnya, setiap politisi dan pengamat menawarkan pandangan yang proporsional dan seobyektif mungkin yang menempatkan publik pemilih pada posisi rasional, tidak tergiring ke salah satu sudut ekstrem pandangan tertentu.

Namun wacana dikotomi sipil-militer masuk akal dan berguna jika dilaksanakan secara kritis konstruktif. Untuk bahan mawas diri dan mengambil pelajaran bagi calon presiden. Bersama dengan sikap kritis konstruktif, agar dipahami dan dihormati pula dimensi-dimensi lain dari demokrasi, sistem dan prosesnya. Bahwa akhirnya, lewat pemilu, yakni pemilu presiden secara langsunglah, pilihan dan putusan dibuat oleh rakyat pemilih.

A GEURRA DE MANUFAHI (continuação)



 Os acontecimentos ocorridos nos meses de Maio, Junho Julho de 1912.

Durante aquele mês as forças do governo avançavam lentamente sobre o reduto de Cablac. O governador Filomena da câmara dirigia as operações. Nesse período o governo dispunha de 21 oficiais, 463 soldados de primeira linha, 597 moradores e 7.757 auxiliares. Estes provinham dos reinos de Fatomasi, Liquiçá, Maubara e Maúbo. Estas forças estavam colocadas á volta de Cablac, e iniciam o ataque no dia  25 ou 26 de Maio.

Mas os manufaistas conseguiram levar melhor sobre os atacantes que foram repelidos. Do alto das montanhas sucediam-se avalanchas de rochas que resvalavam pelas encostas. Os auxiliares retiram-se em debandada deixando dois mortos atrás de si.  A 27 de Maio quatro colunas apoiadas pela artilharia voltam ao ataque. Da montanha choviam pedras, rochas, flechas e chumbos. Desta vez, as forças governamentais depois de dispararem 405 tiros nos quais foram gastos 20.000 cartuchos,  conseguiram desalojar os “rebeldes”que abandonam o Cablac de Aituto.

Além das forças acima referida, o governo da Colónia contava com a canhoeira a Pátria. Comandado pelo novo comandante Gago Coutinho, o navio largou de Díli, no dia 24, para a costa sul transportando carga, mantimentos, armas e munições para as guarnições que cercavam Leo-Laco, uma das quais era comandada pelo capitão do porto de Díli, 1º tenente Manuel Paulo de Sousa Gentil.

Tinha ancorado no taci mane, em frente de Betano. A presença da canhoeira deu apoio decisivo às tropas em terra, onde se encontrava o 2º tenente Mesquita Guimarães. No dia 27 de Maio, o navio bombardeava Leo-Laco com peças de 100 mm. Embora s marinheiros não vissem os danos causados pelos bombardeamentos, contava-se em Díli, algumas bombas caíram na residência da rainha de Betano, onde estavam reunidos vários datos. Parece que houve vítimas naquela localidade.

No dia 29 de Maio, as forças do governo tomavam Ablai.

O navio fez a patrulha à volta de Betano durante sete dias. No dia 4 de Junho a Pátria regressou a Díli, Entretanto, as forças terrestres iam avençando sobre Riac e Leo-Laco. O capitão Azevedo avançou para as rampas de Caicassa, enquanto o governador descia para Rotuto e Ablai-Dum. O comandante Ramalho realizava rondas  ao norte de Cablac  para garantir a passagem dos arrais para a zona de Hola-Rua.

No dia 4 de Junho os homens de Dom Boaventura abandonaram o acampamento Leo-Mali, em Tarucuamo, lugar que foi imediatamente ocupado pelas guarnições do governo. Tempo depois os portugueses e os seus aliados tomavam o sitio de Tui-Ura. Os diversos destacamentos iam ocupando zonas de Manufahi. Os tenentes Magalhães e Pinto com os arraiais de Liquiçá ocupam Same; O capitão Faure da rosa, à frente dos arraiais de Baucau ocupava Leorai e as regiões mais a sul. No flanco direito de Cablac o tenente Gentil que tinha ido de Suro acabava de acampar em Leo-Lima. No dia 9 de Junho, o governador estabeleceu o acampamento e quartel-general em Raimera.

A região de Raimera era coberta de densa matagal. Ali os manufaistas tinham construído muros de pedra, sebes de bambu e ramos de árvores para impedir a passagem aos malaes. A tomada de Raimera por parte dos portugueses durou três dias. Finalmente no dia 14 de Junho de 1912, o governador conseguiu ocupar Riamera, depois de ter sido apoiado  por um pelotão da 8ª companhia, de oradores e arraias de auxiliares.

Na zona sul, o capitão Faure da Rosa à frente dos moradores de Baucau acabavam de ocupar a região de Turon. Entretanto houve lutas renhidas entre os rebeldes e os moradores. Os “rebeldes” chegavam a atacar de note os postos de Tir-Guer entre Turon e Tir-Ai.
Nos dias 15 e 16 de Junho, as forças do governo punham cerco a Riac que conseguiu resistir até o dia 16 de Julho. Nesse fatídico dia Riac rendeu-se. Foram feitos prisioneiros 4.500 manufaistas. Os valorosos “rebeldes” entregaram 342 espingardas milhares de catanas e azagaias. Mas Leo-Laco continuava inexpugnável! Nesse monte lulic Dom Boaventura iria resistir até Agosto de 1912.

A GUERRA DE MANUFAHI (VII)

Como dissemos nas crónicas anteriores que durante os meses de Fevereiro e Março do ano de 1912, estavam decorrer as operações contra o reino de Manufahi.

O avanço das forças governamentais apoiadas por arraiais dos comandos militares ia tornando mais difícil a vida dos timorenses em rebelião. As áreas de Cablac ocupadas pelos “manufaistas” iam-se tornando mais estreitas. Dom Boaventura da Costa, a família e muito povo encontravam-se entrincheirados nas fortalezas de Riac e leo-Laco.

As consequências da guerra eram várias: aldeias abandonadas, casas incendiadas, roubo de gado; abandono de culturas (café, milho e arroz), doenças, fome, e morte. Tanto da parte dos rebeldes como doas forças governamentais havia muitos feridos e dezenas de mortos. Fizeram-se dezenas de prisões. Na Praça de Díli, em 1912, havia mais de 4 mil prisioneiros na cadeia.

Mas, não era só à volta de Cablac que decorriam as operações contra os rebeldes. Na região de Bobonaro as forças do governo realizaram vários “raids” contras as populações. Houve operações à volta de Bobonaro, Atabae, Atsabe, Hatolia e Cailaco. Essas operações tinham o objectivo de eliminar possíveis revoltosos e de impedir a sua passagem até Manufahi. Mesmo assim, os portugueses registaram entre as suas fileiras, 30 mortos e uma centena de feridos.

Sucedeu, então que em vários reinos, sobretudo, da parte ocidental, muitas pessoas começaram abandonaram as suas aldeias, procurando refúgio nos reinos vizinhos ou no território de Timor holandês.

Famílias inteiras de Atsabe, Leimean, Deribate Cailaco dirigiam-se para Memo e para a fronteira. O êxodo destas famílias ocorreu nos dias 9 e 10 de Maio de 1912. Foi nesta ocasião, que o régulo de Memo, Bere-Tali perpetrou o massacre contra os fugitivos, nas margens do rio Malibaca. Segundo o Relatório das Forças da Fronteira, o régulo e os seus homens mataram mais de 100 pessoas, entre as quais 6 chefes. Nos fins de Maio, na povoação de Sadi, no território holandês, havia 2.000 refugiados timorenses.

Conta-se que em Atsabe, as pessoas preferiram morrer de fome e de sede nos seus esconderijos a entregar-se às forças governamentais. Conta-se ainda que os timorenses fiéis ao governo, numa das suas campanhas pelas aldeias, cortaram mais de 300 cabeças aos seus inimigos.

O corte de cabeças era um acto de valentia. Morto o inimigo, a cabeça é decepada e levada para o acampamento. Os acampamentos das tropas em Maubisse estavam enfeitados com cabeças cortadas.

No mês de Abril de 1912, Dom Boaventura escreveu ao governador Filomeno da Câmara apresentando as condições da sua rendição. Mas o malea boot (embot) não fez caso do pedido e continuou a reforçar as suas posições no terreno.

No dia 29 desse mês chegavam a Díli mais reforços. Tinha atracado um navio português que levava a 9ª Companhia de soldados moçambicanos, (seis oficias, 14 sargentos e 233 soldados). Metade dessa companhia seria encaminhada para Suro, via Liquiça, Hatolia e Atsabe.

 

A REVOLTA DE AMBENO (Continuação

A revolta de Ambeno iniciada pelo régulo Dom João da Cruz Ornai deu-se no dia 22 de Março e não no dia 25, como eu tinha escrito na crónica anterior. Recebia a notícia da revolta em Díli no dia 26 de Março de 1912, o governo decide mandar a canhoeira a Pátria a Oe-Cusse com o objectivo de dominar os revoltosos. Aprontou-se o navio que transportou uma força de 40 soldados moçambicanos e 3 sargentos sob o comando do tenente de infantaria Sérgio Morais e Castro e 31 moradores de Baucau, tendo à frente o alferes Afonso da Costa. Pelas 16.00 horas do dia 28 largava o navio para Pante Macassar. Em Batugadé, embarcaram o tenente Jorge Figueiredo de Barros, comandante militar de Oe-Cusse, o régulo Dom Hugo da Costa, alguns chineses e 25 moradores, todos fugitivos de Pante Macassar no dia dos ataques dos homens de Ambeno. (Na crónica anterior eu tinha dito que o padre António de Morais também tinha seguido para Batugadé, mas cometi um lapso, afinal ele estava em Oe-Cusse).

Tendo o navio a Pátria chegado em frente da vila, viram um beiro a dirigir-se para o navio conduzindo o missionário Padre António Januário de Morais e um timorense que relataram ao comandante do navio factos ali ocorridos.

Entretanto deu-se o desembarque das forças. Os portugueses ao aproximarem-se da terra, foram recebidos pelos “revoltosos” com haklalas e tiros. Pelas setes horas, a canhoeira abriu fogo com as peças de Hotchkiss e fuzilaria.

Da terra, os “ambenos” entre 500 a mil 1.000 homens, respondiam com tiros de espingarda Remington que tinham roubado no posto. Fez-se o desembarque das forças que foram ocupando posições em terra. Na troca de tiros ficaram feridos dois moçambicanos. Do navio fez-se o bombardeamento da povoação. Os moradores iam deitando fogo às casas. Nas matas que cercavam a povoação de Pante Macassar pululavam os “revoltosos”. A rainha de Oe-Cusse e algumas mulheres e crianças procuraram o abrigo no navio.

A “reconquista” de Pante Macassar durou dois dias. Nessa acção empregaram-se bombardeamentos com 10 granadas ordinárias e 10 granadas ordinárias, e 2.600 cartuchos de carabinas. Os portugueses reocuparam a casa do comando. Entretanto generalizou o incêndio pelas restantes casas de Oe-Cusse. Ao meio-dia do terceiro dia, o comandante, acompanhado de dois oficiais foi à terra iças bandeira verde-rubra.
E o que aconteceu a Dom João da Cruz Ornai? Vendo o destacamento de guerreiros ambenos derrotado e desfeito, o liurai tomou o caminho do exílio e foi viver com a sua família na povoação de Lelogama (então território holandês). Em Dezembro de 1912, o governador holandês, no seu périplo por alguns regulados de Timor holandês encontrou ali os irmãos da Cruz Ornay, “homens educados em Dili”. Seria dom João e o irmão? Ou seriam os filhos?

Todo o enclave de Oe-Cusse e Ambeno seria totalmente ocupado depois da guerra de Manufahi, facto que só aconteceu em 1913.

Dom João da Cruz Ornai era filho de Dom Pedro, rei de Tul-Ikan, e neto de Dom Bernardo. Teria nascido por volta de 1888. Em 1907 foi enviado a Soibada, onde fez a instrução primária no Colégio Nun’Álvares, então dirigido pelos padres Jesuítas. Diz-se que em 1908, ele casou com Bi Sani Taeki Meko.

Durante a guerra japonesa (1942-1945), Dom João da Cruz Ornai voltou a Oe-Cusse tentando ocupar o lugar de liurai. Mas as autoridades portugueses não viram bem essa iniciativa, e, relembrando a revolta de 1912, obrigaram-no a regressar a Kefamenanu (TTU) onde viria a falecer  em  1961. Teria 73 anos.

A REVOLTA DE AMBENO (1912)

Ao mesmo tempo que decorria a campanha contra o reino de Manufahi, no dia 25 de Março de 1912, começava em Ambeno uma revolta chefiada pelo régulo Dom João da Cruz Ornay. Os motivos dessa revolta? Eram vários e complexas. Mas a principal razão era a maneira pouco prudente como foi tratado o régulo de Ambeno pelo comandante de O-Cusse.

Conta-se que o liurai tinha uma irmã que se dizia formosa e prendada pela educação que recebera no Colégio das Irmãs canossianas em Dili. Aconteceu que o sargento dos moradores de Lacló, em serviço em Pante Makasar, apaixonou-se pela irmã do régulo e pediu-lhe em casamento. Dom João Ornay não concordou com essa proposta e, mandou castigar uma criada que servia de intermediária na troca de “cartas de amor” entre a princesa e o sargento. Sabedor do facto o comandante militar chamou ao comando Dom João Ornay e repreendeu-o diante de outros chefes e ameaçando-o com palmatoadas e prisão. “O régulo conservando-se calado, ouviu-o e chorou; levado o incidente ao conhecimento dos demais chefes, deliberaram todos tirar vingança”.

Aconteceu que o sargento Manuel Carlos Rodrigues (malae) se encontrava em Nucheno (actual Padiai). Os timorenses descobriram-no a descansar numa casa. Os homens de régulo amarraram-no com um cordas e, em seguida torturaram-no até à morte. O sargento depois de ter sido amarrado, “o régulo sentou-se em cima dele e, com uma pedra, foi-lhe partindo os dentes e a cara, passando depois a cortar-lhe os dedos dos pés e das mãos que distribuíram uns pelos outros, ao mesmo tempo que exclamavam: - este era o dedo que me dava bofetadas, este o que me dava pontapés, mas agora já não nos dão mais!

A seguir, cortaram-lhe os outros membros, até que morreu no meio de horroroso sofrimentos”. Era o dia 25 de Março de 1912.

Horas depois, Dom João Ornay saiu a encontrar-se com o segundo malae o sargento João Bernardino que ia a caminho de Oe-Cusse. “Ao vê-lo convidou-o a apear-se do cavalo para ir ver um porco gordo que tinha acabado de matar”. “O sargento não queira demorar-se mas acedeu ao convite. Apenas se apeou passaram-lhe uma corda ao pescoço para o prenderem, despiram-no e mataram-no pelo mesmo processo, apesar dos rogos e das súplicas das vítimas. Foi feito em bocados, conservando-lhe a cabeça, á qual arrancaram o coiro cabeludo para fazerem estilo.” [1]
Depois destes crimes, Dom João Ornay dirigiu-se ao comando militar do posto de Wine (Timor Holandês) e pediu auxilio. Quando o comandante lhe perguntou o que queria, o régulo respondeu” Fazer guerra até morrer”. O comandante holandês concordou com a ideia do régulo e até lhe disse mais: “se não se aguentar com eles, e precisar, acolha-se aqui”. O comandante convidou ainda o missionário de Oe-Cusse, padre António Januário de Morais para se acolher na região de Hau-Mene.[2]

Os homens de Ambeno conseguiram entrar no reino de Oe-Cusse obrigando o Régulo Dom Hugo da Costa, o comandante militar, o tenente de infantaria Jorge de Figueiredo de Barros, dois europeus e alguns chineses e 25 moradores a fugirem num beiro para Batugadé.

Por causa destes factos, o governo português tomou a decisão de enviar ao enclave a canhoeira Pátria para repor a ordem e a soberania.
