Internet Exclusive: Rice Parliamentary Commission of Inquiry Starts. $41 Million in February 2009 contracts revealed.

The National Parliament of Timor-Leste has established a Commission of Inquiry to investigate the facts and circumstances of Government rice contracts as a result of the ongoing Ricegate scandal and the massive rice contracts being awarded to businesses allegedly as a result of political connections in Timor-Leste.

Tempo Semanal broke several issues relating to this story in 2008 and again in 2009.  See here for background stories. The Parliamentary Opposition has been calling for the establishment of such a Commission for many months.

The Terms of Reference for the Commission is below.

Two days ago the Commission of Inquiry questioned the Former Head of Procurement and currently Director General of the Ministry of Finance Fransisco Borlako. Yesterday, the Commission questioned the Minister responsible for managing the rice contracts - Minister for Tourism Commerce and Industry (MTCI), Gil Alves, as well as Directors from the MTCI.  

According to the Commission's plan it will question the Minister for Social Solidarity Micato Alves, along with the Secretary of State for Natural Disaster.

The matter of rice continues to remain a major political issue in Timor-Leste and Tempo Semanal can reveal, as result of a new documentation being leaked to Tempo Semanal in the last few days, that 26 February 2009 an additional $41 million in rice contracts was awarded to 12 companies - the many of which also received similar size contracts in late 2008.

Parliament Divided Over Proposed Massive Pay Hikes for Timor Politicos

On 29 September 2009 Parliament became deadlocked over divisionsgenerated over the proposals to increase salaries for political posts such as:

1) President of the Republic
2) Prime Minister
3) President of the National Parliament
4) Ministers 5) Secretaries of State
5) Secretaries of Parliamentary Committees
6) Presidents and Vice Presidents of Parliamentary Special Commissions
7) Presidents and Vice Presidents of Political Party benches in Parliament

Some Member of Parliament increases more than 600% from $450/month to up to $3,250/month - plus @2,437.50 bonus. Total minimum Member of Parliament income $5,687.50/month. (equivalent to 60 months salary, or 5 years salary for persons on minimum wage $95/month).

The salary for President of the National Parliament will increase 300% from $1,000/month to $4,000/month - plus monthly bonus increase 700% from $500/month to $4,000.00. As a result Fernando Lasama will be earning $8,000/month.

Deputy Speakers and Leaders of each bench will receive $3,500/month - plus bonus $2,800/month, for a total of $6,300/month.

Ordinary Members of Parliament monthly salary will increase to $3,250/ month - plus a bonus of $1,950 for a total of $5,200/month.

The Secretary for each Commission [Committee] and Leaders of sub- Commissions each receive $3,250/month - plus a monthly bonus of $2,112.50/month for a total of $5,362.50/month.

The Prime Minister will receive $8,000/month.

The two Deputy Prime Ministers will receive monthly salaries of $3,500, plus a bonus of $2,800/month for a total of $6,300/month.

Ministers will receive $3,200/month, plus a bonus of $2,437.50/month for a total of $5,687.50/month.

Deputy Ministers and Secretaries of State will receive $3,000/month, plus a bonus of $2,100, for a total of $5,100/month.

The President of the Republic every month will receive $10,000. 

Timor-Leste is the poorest country in the region and one of the poorest in the world.

Most of its budget is derived from Oil and Gas revenue, and income tax only generated $40 million in this year.

Sustainability of these proposed pay increases is in serious doubt even if passed.

Mr. Manuel Tilman, Member of Parliament is determined to defend these increases, stating that the Oil Fund can pay the increases.

The Timorese Members of Parliament are seeking to benefit from their political positions while most Timorese in the rual areas still do have adequate roads, water supply, electricity and other basic needs.

While State expenditure will pay for these salary increases most Timorese MPs remain absent from work much of the time on Mondays and Tuesdays, and the majority only attend in a tardy fashion.

"I think that Parliament has to serve the peoplebut they always do what they want for themselves first," said Fransisco Soares, a university student. "They have no morals," and he continued to challenge the Members of Parliament. "They should be ashamed of themselves by increasing their own salaries..

Last year University Students protested over the Parlaimentary purchase of 65 vehicles for Members of Parliament, these proposed salary increases are approximately 5,000% more expensive than the new
vehicles.

Horta Threatens to Resign: Parliament Surrenders

President Jose Ramos-Horta has threatened to resigned from his post after yesterday' vote in the National Parliament of Timor-leste which barred him from official travel to New York.

Yesterday 10 MPs voted against and 16 for his request to travel while 3 abstained. President Ramos-Horta responded by threatening to resign within 24 hours. He gave them a deadline of 1700 today for the MPs to change their votes. At 1727 today Parliament acted as a rubber stamp
and voted for him to travel 31 for, 10 against and 5 abstentions.

President Ramos-Horta met with foreign representatives in his palace to inform of them his intentions.

"Seeing as yesterday Parliament over stepped their consitutional competencies and have intefered in the working of the Presidency I will take a stand." said President Ramos-Horta in a press conference this evening.

He is now satisfied with the vote and after the Parliament reviewed its position. But the debate in Parliament was very hot. FRETILIN MPs were split on the issue while AMP MPS voted en masse to rubber stamp the process.

PUN Leader and MP Fernanda Borges said right now timor leste is facing an institutional crisis. "we in this Parliament have established a bad precedent for the future and we are not being mindful of the people's aspirations to have truth and justice."

Ms. Borges was in Suai yesterday to participate in the tenth anniversary of the Suai Church massacre for which there has yet been no justice - despite the fact one the perpeprators was captured and then released.

"However Mr. President and Prime Minister violated the constitution to released people from prison on their instructions despite the fact they do not have the Consitutional right to do it.

This is the reason this parliament voted the way it did yesterday. This is a protest vote to open our eyes." she continued that, "if we are truly a democratic state and not a disctatorship of Mr. Ramos Horta or Mr. Gusmao means we must demand the resignation of the two. And not that the President should threaten to resign."

Horta says that under the consitution he is responsible to the Prime Minister and not to the Parliament. He claimed that Parliament should have called upon the Prime Minister to explain Government policy rather than playing politics with the Presidency.
