Horta Urges Timor Telcom Not to be Afraid

In answering questions from journalists regarding the Timorese telecommuincations sector and the populations demands for better service for the country President Jose Ramos Horta praised Timor Telcom for reducing prices in the last month.

A few months ago President Ramos-Horta was highly critical of Timor Telcom calling for the Government to liberalise the telecommunications sector.

 

Now he says "do not be afraid of competition".

He informed the public that the Government has given Timor Telcom 6 months until March 2010 to cover the entire country with their network or there will have to be a renegotiation of the monopoly that Timor Telcom currently holds.


Horta said that he is in support of liberalising the telecomunications sector in TL.

Timor Telcom is not Afraid of Competition

Portugal Telcom Executives visited Dili in September 2009 in order to annoucne that they have a new development for Timor Telcom and the telecommunications sector in Timor-Leste.



The Government of Timor-Leste gave a concession contract monopoly to Timor Telcom, a subsidiary of Portugal Telcom, in 2002, shortly after the country gained independence.

According to the contract Timor Telcom (TT) is the only operator with the exclusive right to provide telcoms services in the country.

There has been a lot of criticism of TT's service over the past years from clients, people in the Districts as well as the President of the Democratic Republic of Timor-Leste.

But as the new Adminsitrator of TT told Tempo Semanal in an exclusive interview TT has established three targets to provide better services.  It has reduced price as now there are some banners flying around Dili streets which say that one minute call US$0.06 and per sms cost only US$0.03 as well they are building more towers in the country.

PRH, Pires Determined for TL Pipeline
Comments by President Ramos-Horta and Secretary of State for Natural Resources, Alfredo Pires, indicate there are more gaps regarding the nation's natural resources than that which lies in the Timor Sea.

Timor-Leste's leaders are still at odds with foreign resources companies over the best way to exploit the Greater Sunrise oil and gas field.

Speaking to Tempo Semanal from New York last week, President Dr Jose Ramos-Horta said, "I continue to defend that the pipeline should come to East Timor".

"One pipeline [is] already going to Darwin from Bayu Undan, so this pipeline [Greater Sunrise] should come to East Timor. And if Australia is to be fair and wants to really have help neighbour like East Timor, wants a stable and prosperous neighbour, it should help East Timor with the pipeline, instead of trying take away the pipeline from East Timor to Australia," Dr Ramos-Horta continued.

The President dismissed fears that Timor-Leste was not stable enough for on-shore processing and export, saying, "This is total misinformation. East Timor is as safe as Australia and safe like any country."

While he did not comment on whether natural resource mismanagement may destabilise Timor-Leste in the future, Dr Ramos-Horta continued, stating, "There so many countries around the world where they have oil and gas that are much less safe than East Timor. Look at Nigeria and look at Iraq: are they are going to stop oil and gas exploration and production in Nigeria and Iraq?"

This position differs from that of Woodside Petroleum, the Australian company that leads the business consortium—which includes companies such as ConocoPhillips, Osaka Gas, and Shell—that intends to exploit Greater Sunrise.

A spokesperson for Woodside last week confirmed the company's ongoing position that it has abandoned the Timor-Leste pipeline option, and would decide between a floating Liquefied Natural Gas (LNG) processing facility (the first of its kind in the world), or a pipeline to Darwin by the end of this year.

"We will be pursuing the most commercially viable option for all parties involved," the spokesperson said.

The spokesperson could not reveal details about Woodside's non-Timorese processing plans or its position on national security if a pipeline was constructed to Timor-Leste, but said studies were currently being conducted to determine which of the two non-Timor-based options the company will pursue.

The spokesperson also stated that future negotiations would follow existing treaties regarding political and commercial involvement in Greater Sunrise.

The Timor-Leste Secretary of State for Natural Resources, Alfredo Pires, last week dismissed the Darwin pipeline option and continued to endorse constructing a pipeline to Timor-Leste, stating via SMS that, "It is technically possible, commercially viable and legaly [sic] merited".

Yet a February 2008 report by the Timor-Leste Institute for Reconstruction Monitoring and Analysis (La'o Hamutuk) cautions that there are more than just technical, commercial, or legal risks that a Timor-Leste pipeline presents.

The report (available at www.laohamutuk.org) is titled Sunrise LNG in Timor-Leste: Dreams, Realities and Challenges, and states, "… fragility and inexperience of state institutions, lack of human resources, inability to implement government programs [must] be overcome before a project like the Sunrise LNG plant can safely and effectively benefit current and future generations. Before companies will invest billions of dollars in a plant on our shores, they, their customers and our people must be confident that the facility will operate harmoniously for three decades or more".

The report states Timor-Leste's people need to be better-informed of their government's plans for LNG development; that adequate laws be implemented to safeguard land rights, environmental sustainability, traditional cultural values, accountable governance, and the rights of workers involved in an on-shore LNG plant; and that Timor-Leste's population be properly trained to work within such a venture.

The report recommended delaying construction until 2015 because these goals are yet to be achieved, in order to, "[give] us more time to prepare to receive its [Greater Sunrise's] benefits. Although these options may be less preferable for the companies, they would be better for Timor-Leste's people".

If the three- to six-year construction process doesn't commence until 2015, all involved parties still must agree on a development plan that incorporates this before the Certain Maritime Arrangements in the Timor Sea treaty expires in February 2013 (as stated in the accompanying illustration from Sunrise LNG in Timor-Leste). This gives the Government of Timor-Leste three-and-a-half years at most to demonstrate to the Australian Government and Woodside that it is capable of managing an LNG processing plant and associated activities in Timor-Leste.

Despite this, the Government of Timor-Leste is adamant that a pipeline to Timor-Leste can be viably managed. Last June, Mr Pires stated the Government was prepared to wait if
Woodside was not yet convinced of the Timor-Leste option, stating, "Right now if things don't progress and move in a fair manner, Timor-Leste will be pressured to take what I call the fourth option, which means to leave it [Greater Sunrise development] to future generations".
Relations with the Government of Timor-Leste and Woodside have been tested in the past, with Tempo Semanal's publication earlier this year of excerpts from a 2004 report by Norwegian company, Lucon A/S, which criticised the Australian company for misleading the Government of Timor-Leste into thinking the Timor-Leste pipeline option was unviable.

"[The National Petroleum Authority] feels that Timor-Leste option has not been given the right attention," Mr Pires said. "In particular now, we have studies from the side to proof that the Timor-Leste option is much more viable than what we've been lead to believe." 

TP Defends Stance and Promises Progress

The following is a statement made last week by Zeinal Bava, the president of Telecom Portugal. 

Telcom Portugal in a number of countries operates competitions. In all of those markets where we operate against other operators, we are leaders so we are not shy of competition.
What I can tell you is that we have a concession agreement. We invested in Timor when it was just become independent. So I think we have gone through the pains of social unrest and so on and so forth.

We have concession agreement which, in some extent, give us certain rights and certain responsibilities as well. And, as far as we are concerned, the strategic plans that we are announcing today provide the roadmap for the local government to judge our efforts against. And six to nine months from now if we are not able to deliver the result then I suspect we have to seat down with the government and discuss various options.

Having said that, as you know, the concept of competition in Telecoms goes well-beyond just having local competitor. Our competition increasing as the world wide web. So from that standpoint, in the years already a significant competition in Timor particularly in Internet site.
As you can imagine the content of my discussion with Prime Minister is private, so I will not share with you what we discussed. But what I can tell you is that we relayed to him exactly what I just told you that we are confident of the future outlook of Timor-Leste.

We are very confident of our own ability to deliver on the strategic plan. And this strategic plan—if implemented, and I think it will get implement well by us—will put Timor and will make Timor as a reference point in terms of network architecture and telecom performance in this region.

Reforming the Security Sector :
Facing Challenges, Achieving Progress in Timor Leste

The idea to write the present article came about when I read the report by the investigation team assembled by the Government to study the "Maliana Case", the letter dated 3 July 2009 to the Prime Minister by the Representative of the Secretary General of the UN in Timor-Leste, Dr Atul Khare, on human rights violations by PNTL and the F-FDTL, and the report on the unilateral investigation carried out by UNPOL on this matter. My purpose in writing this article is to encourage a reflection on the approach taken by foreign personalities, agencies or countries in Timor-Leste regarding the reform of the security sector. Also, I am often puzzled with the carelessness displayed by many foreign reviewers who assess our work.


I ask the agencies listed in this article to take my words as food for thought rather than negative criticisms. I trust this article will contribute to strengthening cooperation between Timor-Leste and other countries, as well as between Timor-Leste and the UN.

The State of Timor-Leste, through the President of the Republic, the President of the National Parliament and the Prime-Minister, created last year a strictly Timorese team called Group for the Reform and Development of the Security Sector. It is expected that the Reform of the Security Sector will enable the development and consolidation of the existing agencies, so that they may perform their tasks with efficiency, legitimacy and accountability, thereby ensuring safety to all citizens. It would do well to remind that this reform of the Security Sector is directly linked to the Government's policy concerning the development of its Program. This is why the Group for the Reform of the Security Sector was assembled in the first place. As such, the team is coordinated by two Secretaries of State, namely the Secretary of State for Security and the Secretary of State for Defence.

The said team has been doing an excellent job along with the advisor to the President of the Republic, Dr Roques Rodrigues. The so-called High Level Meetings on the Reform of the Security Sector, where issues concerning the Reform of the Security Sector are debated, involve the President of the Republic, the President of the National Parliament and the Prime Minister, in addition to the two Secretaries of State and some advisors. The UN has also put together a team to support Timor-Leste regarding the Reform of the Security Sector, under the cooperation agreement with the Government of Timor-Leste signed in June 2008. Despite positive reviews by some friends who think the program has been developing for the past year, I do believe that they do not have a Security Sector Reform implementation program. I feel that this is due to the fact that the UN only takes part in the context of "assistance" in conformity with is mandate, which would be important to understand in terms of a peacekeeping vs. peacebuilding dualistic analysis. Indeed, during this period the UN team has held a seminar, placed advisors at the Ministry of Defence and Security in a unilateral manner and has been carrying out mentoring and retraining actions in the PNTL. It seems that the mandate of the UN is only to work alongside with the Secretary of State for Security, particularly with the PNTL. Effectively, in the Sector of Defence it seems that they only work alongside us to speak about training in Human Rights, separation between the roles of the Police and of the Military, advisors and Military Liaison officer training. I myself have requested them to provide training to the F-FDTL in terms of Peacekeeping Forces, but so far no plan has been submitted to us.

When I, in my capacity as Secretary of State for the Defence, meet with a representative from the UN or any country, I tell them two things: firstly, that advisors must present me (in my capacity as Secretary of State and Timorese citizen) several options, as well as their negative and positive implications, so that I may make my decision. This means that no advisor can present me a single option and ask me to follow it, claiming it is the only possible choice.

If on one hand we live in the age of globalization, where the classic concept of State sovereignty has become dimmed, as a result of the need for transparency, cooperation and even the right of interference, where the Timorese sovereignty is limited to the Flag and the National Anthem, as well as some gestures of courage to make decisions without pressure by other States, on the other hand Timor-Leste is a small country but is nevertheless a sovereign State. Consequently its position in relation to any issue has the same value as that of any other State. Accordingly, other States must respect Timor-Leste as the sovereign Nation that it is.

Secondly, I always tell them that the development of the Sector of Defence must be based on bilateral cooperation. This is important for Timor-Leste to be able to set the military system format it wants to establish. This format surely does not include a myriad of different training actions provided by various countries. Should this come to pass, I do not know what the Timorese military system would become. This is why the F-FDTL command has decided that presently the basic military training provided is to be based on the Portuguese system, which is in accordance with the NATO standards, with the possibility of specialized training being based on the systems of other countries. The purpose of this is to provide uniform training so as to enable an efficient Timorese military system in the future. This is preferable to having each country implement its system in the F-FDTL, which would create considerable confusion.

Until 2007 Timor-Leste did not have a National Defence Law and there was no legal diploma approving the Organic of the Military Police. These are just two examples within the scope of legislative drafting. In this field, and in relation to the Sector of Defence, the Government is not required to announce what it is doing or to report to the UN. Nevertheless, we can summarize the reforms completed up until now:

Firstly, at a legislative level, we can highlight the Decree-Law approving the Organic of the Ministry of Defence and Security, the Draft National Security Law regulating the cooperation between the PNTL, the F-FDTL and Civil Protection, the revision of the Military Service Law and the Decree-Law on its regulation, the Draft National Defence Law and the Remuneration Regime for the F-FDTL; currently being prepared we have the Legal Regime for the Retirement of Soldiers, the Military Programming Law, the Military Justice Code and the Decree-Law on the Promotion to General in the F-FDTL. This Decree-Law is important because there have not been promotions from lieutenant-colonel to general for nine (9) years. Finally, the Secretariat of State for Defence, according to the Government Program, is preparing the necessary changes to the Defence Policy, in order to enable the implementation of the National Defence Law proposed to the Parliament.

Secondly, at a structural level, we highlight that the organic law of the Ministry of Defence and Security enables a clear distinction between the political level of defence and security, as a structure constituted by the Minister of Defence and Security, from the military level of the F-FDTL, as well as the autonomous structure that is the National Defence Institute (NDI).

Thirdly, at a training level, we highlight the definition of a Training System and Concept and the drafting of the new Employment Concept for the F-FDTL.

Fourthly, at an administrative level, the Secretariat of State for Defence has already achieved some goals, consubstantiating the legislative drafting process, particularly in changing the concept of recruitment from a mandatory to a voluntary one, improving the subsidies to the F-FDTL, improving the promotion regime for soldiers, implementing the Remuneration System for Soldiers and reviewing the size and capacity building required for the human resources of the Secretariat of State for Defence.

Fifthly, we must highlight the importance given by the Government to F-FDTL infrastructures and equipment. This is a relevant aspect, as previously FALINTIL worked in Aileu beneath canvases. Even when they were moved to Dili they continued to work in containers, and after the 2006 crisis they were transferred to Tasi Tolu, where they continued to work in containers. As such, it was considered important to repair the Military Training Centre of Metinaro. Also in relation to infrastructures, the Government requested financial assistance from China in order to construct the Headquarters and the Building for the Ministry of Defence. In conformity with this, the Chinese Government presented six months ago the project for the Headquarters and the Building for the Ministry of Defence to the Secretary of State for Defence, which was approved by the latter. Therefore the Headquarters for the F-FDTL is scheduled for construction in 2010. Furthermore, this bilateral cooperation with China will also include the construction of 100 houses for F-FDTL members starting next September.

Within the scope of infrastructures, the Government of Timor-Leste has already allocated an amount in last year's budget for constructing Warehouses, the Military Police Building and the Metinaro Armoury.

In addition to this, and according to a review made by Timor-Leste in relation to information on the problem caused by the entry of an enormous number of illegal fishermen in the Timor Sea, the Government has decided to acquire two patrol vessels from the Chinese company Poly Technology. In fact, the previous Government already had plans to purchase patrol vessels. In 2006 the Government had allocated a sum of 10 million dollars for purchasing the vessels, one million dollars for training and three hundred thousand dollars for fuel, but these amounts were suddenly removed by the 2006 mid-year budget. In 2007, responding to a letter by the F-FDTL, the then Prime Minister Dr José Ramos-Horta stated in a dispatch that the vessels might be acquired in 2008. The purpose of purchasing the vessels is firstly to provide resources to the F-FDTL, the Naval Component and other bodies. Secondly it seeks to enable control of the Timor Sea along with neighbouring countries, especially in the South Coast. Politically it seems positive for Timor-Leste to buy these two vessels.

In relation to bilateral cooperation, agreements were signed with Portugal and Canada. Timor-Leste is also discussing and reviewing agreements with Australia, Indonesia and other States wishing to cooperate with Timor-Leste.

Portugal and Australia are two particularly important States for Timor-Leste, as the existing reports indicated that they are the ones who invest more in our country's defence. We have always received support from Portugal, even during the Resistance.


The Portuguese support to Timor-Leste is based on a Technical and Military Cooperation Agreement that includes, inter alia, support through the provision of advisors to the Training Centre of Metinaro, the Naval Component in Hera and to the F-FDTL Headquarters. Presently a Portuguese Language Centre is being established in Metinaro. Portugal is also assisting in the assessment for border demarcation and maritime authority system for Timor-Leste. In addition, they are providing funding for the maintenance of the two vessels they previously offered to Timor-Leste. They have also offered training opportunities in Portugal for sergeants and officers.

Military cooperation with Australia is also very good. We should highlight Australia's assistance to Timor-Leste through the DCP (Defence Cooperation Program). A clear example of this is the Military Training Centre of Metinaro, where almost all the investment comes from Australia. On 17 April 2008 Timor-Leste and Australia held a forum called Defence Cooperation Talks, where both countries agreed on assistance to the construction of an armoury for the F-FDTL and to the construction of a Specialized Training Centre in the Training Centre of Metinaro. So far, however, only the latter has been completed.

On 26 June 2009 Timor-Leste and Australia met again within the scope of the Defence Cooperation Talks in order to review the 2008 Project and the new projects for 2010. Speaking for myself, I was happy to see that Australia wishes to continue providing assistance to Timor-Leste.

Cooperation with the United States of America is also clearly positive. On 18 August Dili will host a Military Conference between Timor-Leste and the United States of America, also designated as USA-Timor-Leste Bilateral Military Conference. Cooperation is also favourable with the US Command in the Pacific, and we find some agreement points for working together.

The experience with the United States of America has been a positive one, as almost all their activity in Timor-Leste has been approved by the Government, corroborating the idea that, as a sovereign State, any activity done by a foreign State, including the United States of America, must be authorized by the Timorese Government. Accordingly, the sending of US Navy vessels to carry out training exercises in our territory under the Status of Forces Agreement (SOFA), existing between both countries since 2003, requires authorization by Timor-Leste. As such, and since the US plan foresees that 3,000 US marines will travel to Timor-Leste, it would be desirable for these training exercises to take place in coordination with the F-FDTL, in order to enable transfer of knowledge to the Timorese forces.

Once more, although Timor-Leste is a small State, it is nevertheless a sovereign Nation in the World, as evidenced by the cooperation ties it has built, including with neighbouring Indonesia. Indeed, in addition to the countries listed above, Timor-Leste has also improved its relationship with Indonesia. After the visit by the Prime Minister Xanana Gusmão and his entourage to Indonesia in 2008, this country allowed for the first time F-FDTL officers to attend the SESKO Angkatan Laut TNI in Surabaya. In 2010 the F-FDTL will send a senior officer to Jakarta, in order to attend the LEMHANNAS (National Defence Institute of Indonesia) in Jakarta. Furthermore, Brigadier General Taur Matan Ruak has already invited the Chief of the Defence Force of Indonesia to visit Timor-Leste later this year.

Regarding this matter, which is a recurrent one since we cooperate with so many countries, it is important to understand that we do not want to become militarily dependent from other States. This is why we believe it is convenient to cooperate with various countries in the World. As such we have a rather positive relationship with Australia, New Zealand, the Pacific islands and the ASEAN countries. We also have healthy relationships with China, the United States of America, Indonesia, Portugal and so many other countries.

Out of the several activities already mentioned, I would like to highlight the importance to Timor-Leste of the National Security Law and the National Defence Law, as they regulate the role of the President of the Republic as the Supreme Commander of the Armed Forces, as well as the connection between the F-FDTL and the Secretary of State for Defence, the Prime Minister, the National Parliament and other holds of high public bodies. This is a particularly important matter as it helps the Government to "prevent anyone from politicizing the F-FDTL and prevent the F-FDTL to interfere in politics". Indeed, it strengthens the constitutional idea that the Armed Forces must be nonpartisan, according to the principle that "the F-FDTL understand politics but must not participate in political meetings or display their political convictions". I should stress that I learned a great deal during my work with the F-FDTL, as the commanders told me "not to give them anything that they were not supposed to do". This expression serves to show in a clear manner the justification for separating politics from the military establishment.

The National Security Law is also indispensible because it regulates cooperation between the F-FDTL, the PNTL and Civil Protection in emergency situations. In fact, the Organic Law of the Ministry of Defence and Security, which has already been approved, foresees an Integrated Crisis Management Centre. Therefore we must be organized to provide assistance to the population in emergency situations, e.g. caused by some natural disaster. Although I have received no such official information, rumours have it that the National Security Law is not appreciated by the UN, as they say it militarizes the police. I hope that this information is not accurate.

After receiving that information from some Timorese citizens, I told them that foreigners always think that what Timor-Leste does is wrong. Only others do things right. There are events from which we can conclude that Timor is always wrong and the UN is always right! Let us consider the crisis caused by the attack on the President of the Republic and the Prime Minister. Some of the distinguished gentlemen of the UN conveyed to the media that the Timorese were in charge of security. Perhaps they forgot that so far there are two Police Commanders, one from the PNTL and the other from the UNPOL. And it is the UNPOL Commander who is in charge! It was only recently that responsibility was turned to the PNTL in three districts, namely Lospalos, Oecussi and Mantuto.

Let us consider another situation. When the Joint Command travelled to the airport to receive the petitioners arriving from Oecussi and the F-FDTL showed up with the weapons they had brought from the KKO HQ, the UNPOL drafted a report stating that the F-FDTL had threatened them with large calibre weapons. The inaccuracy of this report indicates that the authors forget that in a situation of martial law the military must always be prepared, in what one might call a "state of readiness".

Let us now consider the review of the recent events in Maliana. UNPOL presented a report stating that the F-FDTL breached human rights and threatened Philippine elements of the UNPOL by pointing weapons at their chests. After the High Level Meeting with the President of the Republic, the Government assembled a team to investigate the Maliana events. The team consisted of two officers from the State Ministry, Lieutenant-Colonel Koliati from the F-FDTL and Lieutenant Niki from the Military Police, international advisor Chandrabaland for the Secretariat of State for Defence, Inspector Domingos from the PNTL and Dr Anacleto Ribeiro from the Secretariat of State for Security. The investigation concluded that there was no indication of F-FDTL members having "pointed weapons at the chests of UNPOL members". As such it would seem that UNPOL presented an inaccurate report of the Maliana events, which can only serve the purpose of bringing discredit to the F-FDTL. However, the negative campaign to damage the image of F-FDTL continues. Notwithstanding the report from the investigation team, an article appeared in the Worldpoliticsreview.com entitled "East Timor: Security Sector Relapse?" in which it stated that "the domestic security situation improves in the months thereafter, but the police remained sub-ordinate to the army, which still involves itself in the internal security. According to eyewitnesses, UN Police attempts to intervene in a public order incident in Maliana in June 2009 near the Indonesian border, resulted in F-FDTL guns being pointed at the multinational Forces".

More recently, there was another case in the bar called "Casa Minha". Let us make a more detailed analysis of the event. Information from the police agent who was the victim and the youths who witnessed the event, affirmed that two drunken GNR members beat up the PNTL agent until he fell and for this reason the PNTL agent shot at the wheels of the GNR vehicle. UNPOL makes a report stating that the PNTL agent carried a pistol into the bar and fails to mention the intoxicated state of the GNRs.


This fact warranted the intervention of the PNTL General Commander, Longuinhos Monteiro, who strongly protested to the UNPOL Commissioner, Luís Miguel Carrilho who is from Portugal. Longuinhos Monteiro affirmed that "I ask that the two GNR members who beat up my agent be investigated thoroughly" (STL, 13 July 2009). What is known is that up until now the GNR members have been listed as unknown. Only more recently has there been an investigation initiated on this case, however, UNPOL has already issued a suspension notice to the victim, Police Agent Fransisco Magno HAU, while on the ather hand the GNR from UNPOL who beat up the victim are still free.


In relation to this case, the Portuguese newspaper Correio da Manha (16 July 2009), published inaccurate information in their article "Xanana's security leads an attack against the GNR" and the newspaper Noticias Lusofonia (16 July 2009) printed an article entitled "Xanana's Security Accused of Attacking Portuguese Military".

This is not the first time the GNR and UNPOL have violated human rights. We have the case of the PNTL agent, Constantino de Carvalho who was beaten up by the GNRs until he fell. We have the case of the Baucau PNTL Commander, Adérito Ximenes, whom the UNPOL accused of committing human rights violations against one of their members, but in the end, the Court of Appeal decided in favour of Commander Adérito and determined that the UNPOL member was wrong. We also have the case of the UIR Commander, Agostinho Gomes, whose intervention was aimed at resolving an incident at Manleuana Dili, however UNPOL accused him of human rights violations. Of course the UN wants to defend its reputation as UNPOL or UN but it forgets that it is not a "perfect" institution. If it had been a PNTL or F-FDTL member who was drunk and had beaten up others, perhaps the UN would have moved heaven and earth to produce a report in which they would have written a great deal on human rights. We always hear that alcohol, women and playing with guns do not go well together as they represent a security threat. On this matter we are all in full agreement as long as it does not apply only to the Timorese. In Australia, the military also apply this principle. But it seems that perhaps it does not apply to the UN! It is necessary to understand the fact that each of the interventions from each of the UNPOL countries has been uncoordinated and each has acted as they wanted.

The PNTL General Commander, Longuinhos Monteiro, is currently working to repair all that. What we do know is that if we compare the character, self-confidence and performance of some PNTL members with some UNPOL members, ours are much better. UNPOL members are controlled by politicians from their countries but they still want to teach our PNTL that they are better professionals than we.

CONCLUSION
: We all move according to the principle of "wanting to do what we (Timor Leste) want, rather than what others want". Although Timor-Leste is a small country, we have our own history, conveyed from generation to generation. As such, the Timorese must be able to choose between foreign opinions, since it would be unwise to follow those that merely seek to serve the interests of those countries.

Despite the negative aspects of international cooperation listed above, this cooperation is still extremely important and requires better coordination between Timorese authorities, the UN and foreign experts so that the Security Sector Reform project can move forward. However, this requires honesty by all. The UN and we must think on how we can improve things.

All of us who work on reforming the Security Sector have the strong support of the President of the Republic, the President of the National Parliament and the Prime Minister, seeking to enable the proper reform of the Security Sector of Timor-Leste. Here we should highlight the contributions of the President of the Republic and the Prime Minister, who have always given us the utmost support in order for us to be able to apply that which is written in the Constitution of the Republic.

Finally, under the principle of "we (Timor Leste) do it because we (Timor Leste) want to follow universal values, not because others tell us to", meaning that "we (Timor Leste) want to do what we (Timor Leste) want, rather than what others want", it is important to understand that the experience of other States should be just a reference to us, rather than trying to reproduce it. If we all want to implement the ideal concept of security sector reform, it is important to understand that it will necessarily take its time, as only so can we find what is good for Timor-Leste.

Ramos Horta Exclusive Interview

Horta: Timor Telkom Breach the Contract

President Jose Ramos Horta is travelling around the country trying to listen to the people concern and conducting peace Dialogues with the people in each district. Last week he went to have a dialogue with the people in Atsabe sub-districts and suai district. He was joined by several government officers such as minister of Agricultures, Secretary State for Infrastructure and Public work and others. Ramos Horta convoy went through very bad road between Lete foho Sub-District and Atsabe where there is no phone connection at all. From Atsabe to Zumalai and Foho Rem in Suai district most of these area have no phone connection. In this area the 1996 peace Price winner start firing his words at the Portugal Telcom company which monopoly Timor Telekom. In front of the community Horta calling to liberalise the telecommunication system in East Timor which is monopoly by Portugal Telecom since 2002 up to 2017. In an interview with Tempo Semanal in Dili Horta spelled out the people concern about infrastructures, Roads, Telecommunications. He also expresses his opinion on the issue of corruption and February 11th 2008 trial. Then he finished with the bicycle race in East Timor what he name as the peace race. Please read the full interview between Tempo Semanal (TS) and President Jose Ramos Horta (RH) as follow:


TS: You have experience the lack of Timor Telkom service to the people in the rural area. What should be done to solve the telecommunication problems in this country?


Horta: The government of Prime Minster Xanana Gusmao is taking the right steps in trying to re-negotiate in amicable manner with Portugal Telecom, the lager investor; our government has 20% in the shares in Timor Telecom. And we hope that Portugal Telecom peacefully agrees to the preference of the government, and that is liberalisation. Let through open the market for any operator wishing to invest. A major Irish company with a big presence in a pacific islands and the Caribbean in the Central America, called Digicel is very interested. They have a pledge to invest 100 million dollar with 70 % in the first year with a first class technology, states art technology that will bring down the prices to the level of prices in Indonesia in both of telephone and internet. However, Portugal Telecom still refuses to consider earlier liberalisation which means we have to review the current contract. If we are on a dead lock, if Portugal Telecom doesn't agree to basic follow international practice all over the world, particularly in Europe where there is no monopoly, then I would support the government if the government would decide to terminate the contract with Portugal Telecom. I prefer not to. I prefer that we negotiate with them amicably and wish they agree in a gentleman- manner, bare in mind best into the country that we should liberalise. And any case, liberalisation doesn't mean Portugal Telecom will lose because I believe actually as the example of other country, once liberalisation is effected, there are more users of telephone and internet and actually it is more profitable for Portugal Telecom.


TS: Why Government signed the contract with Portugal Telecom and gave them a monopoly rights?

Horta: Well, in 2001, we had to consider enter into an agreement with an investor willing to invest in communication sector. There was an opening international bid, inviting bidders. There were only two, a small Sydney based company, if I'm not mistaken, and the name is Pacific Communication and Portugal Telecom. Portugal Telecom is a giant company with tremendous penetration in Portugal itself, Africa, Brazil, U.S. and so on. So they won the bid, pledging to invest 50 million dollar. The government at that time we had a very very a little reason to negotiate. We had zero money. And we were forced to accept granting in Portuguese company, Portugal Telecom monopoly for about 17 years. That has been absolutely detrimental to our interest. But I don't blame the previous government. We had no choice. If we didn't accept, Portugal Telecom wouldn't have come here anyway. But it has been now 8 years. 8 years after Portugal Telecom has begun operation here. Up to 70% of territory and people have no coverage. So I believe Portugal Telecom is breaching the pledge, breaching the agreement with Timor Leste by not honouring the pledge to provide reliable, accessible and wide coverage services to the people of this country.


TS: As you travel around the country to have a dialogues with your people. What are their main concerned Please?

Horta: As I travel through out the country people are very very pleased in the sense of my visit. They're very pleased with the current state of peace in the country. They're very relaxed very happy indeed. They are also happy with some of the development that they have seen particularly government cash hand out to the poor people, to the veterans and more support for farmers and for agriculture as well as the government purchasing supply food from farmers like rice, corns, beans and so on. This means that money into the people. How ever every where I go people asking for roads, for electricity and they complain extreme poor quality of telecommunication which is responsibility of Timor Telecom and Portugal Telecom that has contract with exclusive and monopoly with our government and now eight years already. Now I say that close to 70% of the country is still not covering by telecommunication. And what ever discover is mostly poor quality and expensive. People of course still ask for more schools and they asked for water. These are the very basic things that all over that I have been to. I think now is all the districts, many of the subdistricts as well as small villages every body talk about the roads, roads, roads and roads, electricity, water supply and of course, I explained to them that is going to take many years still before we can have the first class roads in this country, maybe another 2 to 3 years before 80% of people in this country will have 24 hour cheap energy.


TS: What are you doing to address the roads problem?

Horta: I have discussed at once with Prime Minister. Prime Minister is obviously extremely sensitive about this. Right now the government is doing a visibility study on major roads in this country. We have about at least 4000 km roads and 70% is disrepair. There is a major power project under a way, which becomes a bit controversial because of its base on heavy fuel with accordant some around counter to

Environmental standards, but the government argues back 'saying no' all environmental concerns are taking care of, the technology appropriates. And that is the only way for the government to provide a cheap energy to the people in the short period time in the next 2 0r 3 years.


TS: After you heard people opinion to have access to good roads it's a challenge to the state. How you will going to money to build the roads?

Horta: I totally understand the difficulties that the government faces. The AMP government can not in two years resolve the roads problem that has been there for decades. The previous government of Dr. Mari Alkatiri also did very little because it didn't have money. A few hundred km of roads that was done in a year was built by Japanese and ADB (Asia Development Bank). Every year we spend millions dollar on fixing roads. That is where I believe the corruption comes in, where the contractors that takes the contract from the government, let's say out of ten million dollar to fix a road, maybe really spent only 5 million dollar, 5 million dollar they pocketed it. That's why the roads, even after repaired, so bad all over the country. So there are problems of management, problem of corruption. I don't blame the government. I don't think it is the minister of infrastructure that is corrupted, I don't think so. It is the lack of capacity on the part of the government to monitor to inspect the quality of the work. So we then are totally hostages of dishonest contractors who rip off this country, rip off the government by not building the roads and repairing the roads properly.


TS: Just to confirm again how East Timor will have money to build its infrastructure mainly Roads?

Horta: I think the government should do a combination of two things. It should set aside a good percentage of the oil money into a special fund. Let's call it National Investment Fund or National Development Fund or National Infrastructure Fund. Let's say separate from the budget, it has the regular recurrent budget, but separate from that. It takes out, let's say two hundred million dollar a year from the petroleum fund just for roads. And if we do this for next 5 to10 years, it means 1to 2 billion dollars. And that will be enough to pay for first class roads to lane for next 5 to10 years. We can invest two hundred million dollar every year on first class roads and bridges, together with the environmental protection that goes along with the roads. That means creating thousands of jobs, sustainable development, and sustainable growth for at least ten years. But if necessary, apart from taking a hundred million or two hundred million from petroleum fund, the government can also negotiate lets say with China. China has one trillion dollar in reserve. We can negotiate with China. Let the Chinese invest in this country in roads, in bridges, we pay them as they progress in the construction. So we have two options. One our own money, exclusively all combination of our own money with loan from China. I don't see any other country or international bank that can lend us money as much as China can do. I have already spoken with the national bank of Paris, very well-known, very prestigious bank,, with gas Prom bank from Russia. They are also willing to negotiate to the government to loan up to one billion dollar to Timor-Leste government. However, we don't know yet how much they will charge in term of interest. That will be a matter for the government to study, to carefully analyse and make a decision.


TS: President you just talk about corruption in East Timor Construction. How serious of Corruption in this country?

Horta: I think a corruption is serious in Timor-Leste. But I reject the charges that the top government officials involved like Prime Minster. Prime Minister is a very very honest person. He wants to do things fast. Because in this country if we want to develop, we want to create jobs, we want to meet the aspiration of people for the better life, we have to make a decision fast. And Prime Minister wants a decision fast. But the problem is that when you make a decision fast, the risk of corruption on this manner can happen. So be it. There is nothing in life one doesn't have risks. Corruption exists at the different levels. But I do not believe it exists at the level of the senior ministers. It can exist in the level of a certain civil servants, in procurement. It exists in term of invoicing, double invoicing in the way when you want computer that really costs a thousand dollar, the government is invoiced three thousand dollar. If you want to buy a simple telephone for the government, that costs a hundred dollar, some one will invoice five hundred dollar. This happens a lot through out the government sector. We have now a senior deputy Prime Minister Mr. Mario Carrascalao. He is very honest, with tremendous integrity. He will work with the government ministers. I don't believe we have to do we cham. We can not point finger to ministers. Because the ministers they work very hard and got very very low paid. They work between 10 to 15 hours. If we just make a accusation and accusation against them, they loose hope, and they just give up and they quit. But what important for me is the deputy Prime Minister and the ombudsman and the parliament work with the government to strengthen mechanism to close any gateway where corruption happens.


TS: Mr. President you just signed the Anti Corruption law. How significant is this to minimise the Corruption in East Timor?

Horta: The first step was adoption of such a law which I promulgated to create Anti-Corruption Commission. That is s first major step, having the legislative bases for that. Next is the election or appointment of individuals and the staff and the infrastructure, logistics that are need by Anti-Corruption Commission a very critical personality curriculums of the commissioner. I do not agree completely with the law where it says basically only some one with legal veteran can be commissioner. I and Most of members of parliament agreed they will try to mandate it next a few months, next a few weeks actually. So economist could be. Let's say someone who is top economist in our banking system. Someone is a top experience, a top economist in the minister finance, who knows about banking, about finance, about everything, dealing with a corruption. But it doesn't have a lot of degree; it does mean he/she can not be a commissioner. How about a priest? How about a sociologist? So I don't agree that a commissioner has to be a lawyer. The deputies and the staffs, yes. The commissioner will have to have people with legal background as well as a criminal investigation background to work with him or her. But a commissioner should be anyone with an experience, with some formal university degree if not university degree, at least a twenty years' experience as administration with integrity assisted by the very strong team. That would be an effective way of dealing with a corruption in this country.


TS: Is this law will be effective to tackle the issue of Corruption?

Horta: Yes, I think the law is very very well researched, thoroughly debated even more then after some of the best law existed. Before the law was adopted the parliament discussed, the government drafted it and they looked at the experience in Indonesia, Australia, United States, Hong Kong and Singapore. So the law is very good one, just need to make the small amendments and the critical issue is give the commissioners resources. Money to hire good people and to fight as well as prevent corruption. But again as I said fighting corruption can't be only punishment but it has to be prevention. It has to be education. We have to inspire civil servant, Government officials about their own sense of dignity. You know when we receive money to do something that we know it is our duty to do; well it's my own sense of dignity, my honour and my pride. So we have to let the people about that. In the mean time we have to pay minister well. We have to pay civil servants well. Look at the case of Singapore. The Prime minister of Singapore is the highest paid person in the world. Singaporean Ministers are the well paid people in the world. So there is no corruption at all in Singapore. So there is strong materials incentive. If you pay people very bad and if you pay a customer officer in Mota Ain (Border between East Timor and Indonesian West Timor) very bad also if you don't look after him. If you don't pay the customs in Dili port and Airport well and someone come to him with US$500.00 bribed to let a container go well it is very tempting. So one you have to inspire people to be patriotic, to be proud and have sense of dignity. But also give them the material means so they don't have extreme necessity to accept bribes in order to survive day today.


TS: What is happening with the programme of elimination of poverty in East Timor?

Horta: I believed that the simple facts that the government already paying twenty Dollars a month to now seventy thousand people. The simple facts that the government already given good money to veterans. Thousands of widows and orphans are getting some formal assistant. And on top of it the many thousands of civil servants every month earn salary. The many many thousands you see in Dili selling things in the shops and on the streets. This all means some income entry their pockets. That make me believed that poverty is been reduced because mathematically some people in a year ago didn't have twenty dollar a month now they have got twenty dollar or more a month. Until two years ago many hundreds of veterans didn't have one cent and now they have many hundreds of dollars or thousands of dollars in their disposal. How ever majority of the people still have no access to clean water, have no access to a dignify housing like at least a roof and a prover floor that means extreme poverty. How long will it takes I believe that if the government want to make major investment in roads that we need for agriculture, for educations and for health that means within five to ten years we can extreme poverty completely eliminate in Timor. We might still see poverty but not extreme poverty. Extreme poverty means might not even have a meal a day, doesn't clean water, no electricity, no housing. So we can eliminate that within five to ten years if the government mobilise at least in my view two billion dollars or more to build first class roads in this country. We desperately need. We need these roads its not for tourism, it's for agriculture, it's for health services, for children to go to schools, for school teachers to be able to go to schools, for the farmers in Maubesi, in Baguia to go down to Baucau or Dili to sell their Bigs, goats and their vegetable and for fisherman in Dili to travel to Aileu to sell their fish. So we need first class road as a matter of urgency.


TS: If you don't mind can we ask a question in regard to the trial of the case February 11th 2008 attempt on your life?

Horta: I will not comment on a trial as such because as the trial take place I will not comment on the substance. I can only say that, I hoped as the trial progress and decision are made by the judges. What ever the decision they made everybody accept them and that we move on healing the wounds of the past. I still have the wounds that were inflicted on me in two thousands and eight and I don't harbour any anger or resentment to those who shot me. Who tried to kill me. I only hope that they will have a second chance to lives their life with their families and look after their children. And we Timorese burry our differences burry our anger and hold hands so that this country can live in peace and stability for the sakes of our children.


TS: Can you tell us about the idea of the bicycle race and what kind of response you have?

Horta: I am very pleased with the response. More then 100 so far Raceter and I think close to 100 international participants. It is getting generate a lot of publicity. Former secretary General Kofi Annan has made a statement and Prince Albert of Monaco also has made a statement. I believe will get more international publicity and more international media publicity and will significant participants. I launch the idea and these initiatives not only as sports initiative but also as part of my peace programme for the next three years. I want in the next three years to have peace rooting in this country. When I leave office in 2012 I tell the nation and the nation can thank me for having contribute a Little bit enhance peace in the country.


TS: How many participants are you expect to participate and when will the race occur?

Horta: Minimum we expect more then 200 participants over 410 Kilometres very difficult mountain routes passing through nine of thirteen districts in Timor Leste. It will involve beautiful mountain landscape as well as shore line. The time is in the year August 24th to 29th. It's best of time in the year that cools no strong humility. So I believed that it will be the greatest experience for people that participating. There is one mountain bike racer from Australia. He is one of the top two or three in Australia who will participate I do not recall his name but there are many others who will come here for mountain bike race. And the week later they have the international mountain bike race in Australia. They are coming to Timor to do like practising and then a week later they will do in Australia. End

East Timor President Jose Ramos Horta called for an end to Portugal / Timor Telecom monopoly and to liberalise Timor Leste telecomunication market to invite one or two new operators to invest in the area of telecomunication. According to the East Timor First Foreign Minister under first Constitutional Government said that Portugal Telcom forced the East Timor government to accept the 17 year monopoly otherwise the it would have rejected to come to invest.

During last week visits to Suai and Atsabe the leading East Timor Diplomat came out with strong statement over the telecommunication operator after listened to his people's complaints.

In october 2007 this newspaper conducted a national opinion poll 36,918 respondents of which 98% want the Timor Leste Government to end the monopoly and free up the Telecomunications sector. The result of the poll were submitted to the President of the Republic, Prime Minister Office and Speaker of Parliament.
Most of the people opinions are Timor Telecom is very expensive and very poor quality so they demand to the government to put pressure on Timor Telecom to reduce the price and provide better service to its clints. A Timorese senior high School student in Dili, Augosto da Costa Santos said Timor Telecom had very bad service to it's client and the connections is always busy and always delay our sms so I think it's time for government to act. Agusto From Liquica said some areas in Liquica itself do not have access to phone connection.
