Timor Leste, the 5th Constitutional Government and the good governance template

East Timorese newspaper Tempo Semanal published an article this week which has been distributed widely without any critical comment. The article claimed that the new Timorese Government represented an oligarchy. It also criticised the new government for its size and for the fact that it contained some brothers and sisters.
It is true that there has been criticism of the last Timorese Government for many reasons including corruption. It is also true that this same government established the Anti-Corruption Commission (KAK) which has led to some former ministers being investigated and in one case found guilty. The claims then that the government is too big and is because of this somehow by inference corrupt should not be left unanalysed.
In comparison with Australia the number of ministries is not large. Timor will have 17 ministries. Australia has 40. In Australia these 40 ministries are concentrated in the hands of only 21 people, that is power is more centralised. But this is not the real point.
In response to some of the comments that have been made on the article my colleague at Deakin University, professor Damien Kingsbury wrote on the ETAN mailing list:
However, if you understand them as being the equivalent of Ministers, Parliamentary Secretaries (same as vice-ministers in other parliamentary systems) and heads of departments with ministerial accountability, then this all starts to look much more like a normal parliamentary system.
If you compare Timor-Leste to, say South Australia (the population of SA is a little larger than T-L, but not much), you will see that SA has 15 ministers - only two less than Timor-Leste, but without the further responsibilities that come from running a country and not a state, e.g. defence, telecommunications, etc.
So maybe Timor-Leste does not have so many ministers after all. It just looks that way when a range of different individuals with different responsibilities and levels of responsibility are put in the same category.
There is a lot of merit in what Professor Kingsbury has said. The first thing is to put the criticisms about size into perspective. Timor will not have 55 Ministers but a mix of Ministers, Vice Ministers and Secretaries of State.
Tempo Semanal quoted the head of Luta Hamutuk NGO, Mericio Akara as saying:
“this new structure will not be effective and efficient, because too big and full of political interest. And full of political interest this structure will be more high cost, and I think every year government need more budgets to serve those Ministers. For us as a civil society better to invest more budget in the development sector rather then invest more budget in supporting new ministers.”
Underlying the logic of the criticism appears to be a logic which promotes an assumption that small government is always good. The argument seems to be that a big Cabinet is expensive and thus wasteful, that Timor is small and has many problems and that this waste can not be afforded.
This was the logic pushed by the United Nations during my time in Timor and implemented though a range of bodies such as the IMF, the World Bank and those NGO's that compose what is called 'civil society'. It appears that not much has changed and if anything critical analysis has all but disappeared. In its place we have criticisms of the new government which all seem to be drawn from the template of 'good governance' espoused by these organisations. Behind this template stands a policy which asserts that the primary function of the Third World state is to universalise private property rights. Small government, handing over its tasks to 'civil society' and the private sector to enable growth and the development of a competitive economy are all touted as the answer to Timor's problems. The latter, a competitive economy, is after all the centrepiece of the opposition party FRETILIN's alternate program for government.
Amongst all of this we have the criticism by some of the Timorese NGOs that argue the new Government structure is the result of political motivations. Underlying this is a logic that somehow government should not be political, or the result of political decisions but only economic ones. The becoming economic of government and of society is itself one of the hallmarks of neoliberalism. The new Timorese government is driven by political concerns – and so it should be. But this does not mean it is not concerned with waste, corruption or nepotism. What the government reflects is firstly the 'will of the people' expressed at the recent election – thus leaving one to wonder who the “us in civil society” mentioned by Akara in fact refers to. It also reflects the long standing practice of Xanana Gusmao to be as inclusive as possible, whether in resistance, the transition or in government. This is good politics and it is good politics that Timor needs along with the stability that the people seem to desire.
One could quite as easily characterise the new government as being more specialised and more focussed in that responsibilities appear to be more defined. Importantly the creation of the portfolio of President of the Council of Ministers, to be held by the former State Secretary Agio Pereira, and the appointment of Avelino Coelho as State Secretary for the Council of Ministers suggests that Prime Minister Gusmao is more than alive to the issue of how his Ministry will perform and the need to keep them accountable. Giving these portfolios to these two experienced and competent politicians can only be a sign of the increased focus upon what the NGO's call for: 'good governance'. This internal check on ministerial power combined with the work of Aderito Soares in the Anti-Corruption Commission can only be a good thing for the administration of government in Timor.
Another criticism levied at the new government is that of nepotism. Timor is still very much a tradition based society. It is not a society where tradition has yet been wiped away in the name of smoothing the space of the globe and making it safe for business. Having worked in both Timor and Arnhem Land I see many similarities in the manner in which society is organised. My point is that tradition and societal bonds in Timor are not just a replica of what we disingenuously call 'community' in Australia. Unlike Australia for example, Timor has community rather than a society of entrepreneurs and consumers. Bonds other than economic ones still exist between people. Family really is the basis of society. Other than that there is only a limited number of people with the skills needed to perform the tasks of government at this point in time. That skills base is further limited by the fact that they are divided up amongst the two principal political parties and nineteen others which contested the recent election. The reality is then that it is almost impossible not to find family members operating in similar areas. The criticisms of the government on this basis need to be put into this context and the manner in which Timorese society has been traditionally organised. To just blindly object to a Government on the basis that some people are related is really not far from saying that what you really want is a government that is not Timorese, in the sense that you want a government which does not reflect the composition of society, but one that reflects some template of 'good governance' promoted in a glossy World Bank pamphlet.
There is a further aspect to this criticism of nepotism that must not be left unremarked. The mantras of growth and building markets, such as those espoused by FRETILIN and some of the NGO's promote a vision of Timor as a fully fledged capitalist society. It is a long way from this at the moment. What private sector exists does so essentially because of government spending of one sort or another. It needs to be recalled that according to the theorists of neoliberalism, such as Hayek the natural state of people was to cooperate and as such competitive markets are not natural, they must be constructed. According to this theory the role of the state is to create the conditions for competition. Throughout history, including today how is this done? It is done by what Marx termed primitive accumulation, through what David Harvey calls accumulation by dispossession. Accumulation of land, money, resources and the dispossession of the people of the same things which include of course the public sector. My point is not to defend this, nor to defend any nepotism or corruption that may be occurring and which is occurring globally. Need I state the obvious and mention the current baking crisis, the austerity drives, or the dismantling of the public sector throughout the world by those that say government should be less political and more economic? Need I mention the growing global revolt against this? But here NGO's and others who want to promote this model, competitive markets, growth, the creation of a middle class and building markets cry foul when the process they champion might actually be taking place. If the NGOs are to be credible they can't have it both ways. They can't just roll out the global 'good governance' template, cry foul and apply it without analysis.
The situation reminds me of the thoughts of Paolo Freire in the opening pages of the Pedagogy of the Oppressed. The NGO's and others seem to suffer from “an absence of doubt”. Their positions are true positions and there is no doubt about that. The manner in which their message has gone viral is itself an example of Freire's “circle of certainty”. On the contrary it seems that the Government does not suffer from such an absence, it is acting politically in a political context and it appears to have given some thought to its previous mistakes and acted accordingly. As Freire might say the NGO's may actually need to confront their own position, to actually think and analyse the template they seem to be operating from. Confront, listen, unveil. Think rather than repeat the glib mantras of the custodians of a crumbling global system.
The new Timorese Government is not an oligarchy. For Aristotle an oligarchia designated the rule of the few for the few, rule that was exercised not by the best, but by bad men unjustly. Aristotle differentiated an oligarchy from an aristocracy where government by the few is vested in the best individuals. In the case of Timor the people decided the best individuals were those that formed the government led by Xanana. It may be an aristocracy but it is an elected one. An oligarchy also infers a ruling power bloc. What is apparent in Timor is that there are no consolidated permanent power blocs. Given the absence of power blocs in the oligarchic sense everything must be negotiated and this is the hallmark of Gusmao's style. Negotiation to the extent that there was even room for the opposition FRETILIN to be included in one way or another in this Government. Something which it seems that FRETILIN rejected. The task of negotiation and inclusion is one that the people and history have currently given to Xanana Gusmao. It is not an enviable or easy task and it is not one that is left to whim to undertake in a vacuum. The reality is that it is a political task and not one that conforms to a pre ordained template.

A Abertura da IIIa Reunião da Sessão Plenária da Assembleia Parlamentar de Comunidades dos Paizes da Lingua Portugues (AP-CPLP)

Desde as 08h00 de manha pela Estrada à frente do portão da entrada do Parlamento Nacional da RDTL se enxia dos alunos do Ensino primário Público da ESCOLA XINA (Bairro Central) com banderolas às mãos agarradas a espera da caravana da Comitiva de AP-CPLP que em conformidade com a agenda do dia para hoje datado aos 21 de Setembro de 2011 que a Comitiva de AP-CPLP irá abandonar o alojamento e a acomodação em Hotel de Timor so às horas efectivas do trabalho para se dirigirem rumo ao Parlamento Nacional da RDTL; por tal razão ao redor do edifício se enxia de gentes com meta de acolhimento à respectiva Comitiva.

Nota-se em contra partida os estudantes da Universidade Nacional de Timor-Leste a concentrarem-se no seus programas e nas suas actividades do âmbito acadêmico como estipulado no Estatuto de CÍVITAS ACADÉMICO da UNTL que  tem por tarefa mais fundamental ao nível intellectual, isto é, estudar e que se formarem intelectualmente.

Ao recinto, pátio e corredores do Principal do Edifício do Parlamento Nacional da RDTL estão cheio de gentes familiares, claro que, com o ambiente do Parlamento Nacional da RDTL, todos abandonaram as suas salas e mejas de trabalhos a estar em bicha a ficar em pê a espera da chegada da Assembleia Parlamentar de AP-CPLP; assistimos como o corpo da segurança tanto das Nações Unidas, Guarda Republicana Portuguesa, Segurança Civil do Estado da RDTL, Forças de Defesa (F-FDTL) e Polícia Nacional de Timor-Leste que estão em alerta e cautela máxima.

E depois de terem se reunidos a sala de cada Bancada, membros da Assembleia Parlamentar de AP-CPLP dirigiram-se ao plenário e a começar a ordem do dia. Marcaram-se presença à meja o actual Presidente do Parlamento Nacional da RDTL o qual será eleito como Presidente de AP-CPLP para próximo período a substituir o actual Presidente de AP-CPLP em Cessante que é oriundo de São Tomé e Príncipe que tem presidido  a sessão da manha e o tal tinha tido o seu mandato para period, 2009, 2010 e 2011; também se marcaram presencas o Sr. Domingos Simões, Sra. Secretária de Angola e o Vice Primeiro Ministro do IVo Governo Constitucional da RDTL.

É interessante de saber que os traços e marcos do Plenário do Parlamento Nacional da RDTL têm sido mudados, de certeza absolutamente, diferentes para com os são de quotidianamente ou seja diariamente em sentido de que os aspectos da formação do contéudo ou seja composição dos elementos jamais (nunca mais) são como os quais deviam ter sido em conformidade aos dias efectivos do encontro da sessão da Reunião Plenária Parlamentar ap do a doa e em normalidade, porque os deputados têm sido em maioria os reprepresentate e membros da Assembleia Parlamentar de AP-CPLP que aparentemente compostos por homens e mulheres vindo de África (Moçambique, Angola, Cabo Verde, Guiné Bissau e São Tomé e Príncipe) e Europa (Portugal) e exepcionalmente os de Brazil que estão ausentes da IIIa Reunião de AP-CPLP em Timor-Leste; e claro, isto só se aconteceria desde aos dias de 19 até 23 de Setembro de 2011 quanto têm ocorrido a precisa e referrida reunião; más e depois disto se tornará outra vez a mesma quer dizer que o Parlamento Nacional da RDTL vai retomar os seus serbiços como o deveria ter estado ou seja o qual tem que ter sido sempre.

Houve discursos pregados por actual Presidente do Parlamento Nacional da RDTL, DR. Fernando La Sama de Araujo e o de DR. José Luis Guterres na qualidade como Vice do Primeiro Ministro do IVo  Governo Constitucional de Timor-Leste nem se quer se esquecer de balance do género; foi portanto convidar Representativa de Bancada das Mulheres Parlamentares da AP-CPLP de são Tomé e Príncipe para prestart também o seu discurso.

Entretanto deu conhecimento à Assembleia Presente que Brazil está ausente nesta IIIa  Reuniãode AP-CPLP.
No entanto o Vice Presidente da Assembleia da República de Portugal Dr. Ferro Rodrigues tem estado presente desde o primeiro dia e ele já se procedeu, ao dia anterior, para as instalações de CAVR em início do trabalho de AP-CPLP em Timor-Leste.

Ao terminar a Sessão da manha; a Comissão Organizadora convidou os membros de AP-CPLP para o almoço em Hotel Timor só com duração à uma hora.

E depois de ter, mal acabado, o almoço, a Comitiva regressou para continuar Sessão de tarde em que mudou a estrutura da meja: ficou como Presidente da meja é a Sr. Secretária de AP-CPLP Angolana, Sr. Presidente de AP-CPLP de Cabo Verde, Sra. Secretária Geral de Actua AP-CPLP de Timor-Leste Maria Fernanda Lay. Com honra Sr. Enghineiro Estanislau da Silva como membro actual de AP-CPLP de Timor-Leste e membro efectivo da Antiga Assembleia Constituinte da RDTL, e membro Parlamento do Io Parlamento Nacional da RDTL, e ex Primeiro Ministro do IIo Governo Constitucional da RDTL em efectivo e pleno e como também membro Comissão Permanente Parlamentar do actual Parlamento Nacional da RDTL prestou breve discurso sobre rendimento e taxa per cápita anual do Estado Timorense, em, de anticipar crise global do impacto economico, que afecta também região Ásia-Pacífica e Sudeste-Asiático e o qual se corelaciona com AP-CPLP.

Na sessão de tarde só se existiam intervenções e pontos de ordens por parte dos membros de cada bancada; e para cada um dos respectivos presente só se dá 10 minutinhos. Ocorreu-se em boa forma de uma intervenção. E depois a Comitiva teve a oportunidade de se aproximar à meja para uma pequen refeição ou seja merenda à tarde a tomarem café e água e a se relaxarem e, claro que, a meja da pequena refeição sempre encontrada cheia de comidas típicas Timor-Portuguesada. Em anticipar, deu-se avizo pelo discurso do seguinte orador será O Presidente de Cabo Verde.

A segunda Sessão Plenária da tarde a Delegação de Cabo Verde é que presidada por Sr. José Manue de Andrade começou por convidar oradora Sra. Margarida Talapa, membro de AP-CPLP de Moçambique de codificar taxa de mortalidade materna-infantil quanto à natalidade-infantil.

Margarida Talapa, pôs-se a intervenção feita por membro de AP-CPLP de Portugal, o qual tem sido o país com taxa de mortalidade intantil à mais baixa ao mundo, não só da região da Europa. Vê-se o ecrã, de que o tal interviniente se senta mesmo, precisamente, por de traz do Ferro Rodrigues.

O Sr. DR. Francisco Miranda Branco e o Enginheiro Estanislau da Silva de AP-CPLP de Timor-Leste interviram por darem as elogias pelo discurso prestado que é tocante ao assunto muito pertinente em Timor-Leste.

Ao terminar, da meja, a Sra. Maria Fernanda Lay fez embrar ao Presidente da meja que os pontos a serem como reflexão são como: Saúde, Redução da mortalidade materna-infantil, Prevenção da gravidez precoce de raparigas ou seja de mulheres adolescents que andam tanto nas Escolas de Secundária até as em Pre-Secundária, e às quais não têm e, que nem sequer terem oportunidade ao acesso da escola, Educação, infra-estrutura como objectivo do Dezenvolvimento Milénio.

Assim terminou-se a ordem do dia de hoje e o Presidente actual de AP-CPLP, Sua Exa Dr. Fernando La Sama de Araujo em qualidade e de direito pleno como o actual Presidente de AP-CPLP e Presidente do Parlamento Naciona da RDTL pediu a todos os membros para que se vestam à vontade com vestidos ou ropas semi-formal par air ao banquete ou à cheia ou jantar para esta noite. Longuinos Monteiro (PNTL Commander) Involved in Cover Up Over Missing Weapons

The Timorese National Police are still losing weapons and the President of the Republic has raised his concerns with the Secretary of State for Security Fransisco Guterres. President Taur Matan Ruak has asked Francisco Guterres to instruct PNTL to recover the recently missing FNC semi automatic assault rifle without delay.

General Lere Anan Timor Chief of the Defence Force has publicly called for the immediate dismissal of the police commander responsible for losing weapons. Lere has stated that "the PNTL member must punished for his mistake, if this happen in FDTL the soldier must be sacked immediately".

Tempo Semanal has learned that the PNTL Commander Longuinos Monteiro has not been truthful over the matter of his police service losing weapons and associated disciplinary matters.  He has stated in media and press conferences that the officer responsible has been suspended two weeks ago but it has only happened 3 days ago, and the officer in question retains access to government assets.  Citizens may contact Monteiro on facebook here: https://www.facebook.com/longuinhos.monteiro

The FNC rifle in question was held by the PNTL Intelligence Unit Commander, Octavio Araujo, in PNTL HQ in Dili.


Tempo Semanal broke the story in 9 August 2012 and it has been picked up be all Timorese media since.

Since then the PNTL commissioner Longuinos Monteiro has told the public that Mr. Octavio Araujo has been under investigation and suspended from his post. But Tempo Semanal has learned that this is not truthful or factual. 

Monteiro told media and public that the missing weapons was not of concern, and that he was conducting investigations.

Mr. Araujo only received a suspension letter on 22 August signed by the PNTL Commissioner.  But Tempo Semanal PNTL sources state that “Mr. Octavio Araujo was suspended from his post on Tuesday this week after getting the suspension letter from the General Commander. But he still has his Government mobile phone and his official car,” said a senior PNTL commander who asked Tempo Semanal not to name him.

Tempo Semanal found that on the evening that Mr. Octavio Araujo "lost" is FNC rifle he was driving his Operational Commander vehicle with number plate 16.002.


According to eyewitnesses in the Indonesian Food Bar, they told Tempo Semanal that Mr. Araujo came to the bar with a Timorese woman  "The car was park here inside this place but we didn’t see he had an FNC rifle. He was drunk. Maybe the gun was in the car I don’t know,” said a person familiar with the bar.

The PNTL considers the woman a suspect in the lost or stolen weapon and PNTL has conducted an investigation but have today discovered that the suspect has fled country to Indonesia soon after the investigation became apparent.

“Some PNTL officers has came to the house today with notification papers but the Ms A. has left for Indonesia,” said neighbor of the suspect to Tempo Semanal.

In the mean time the investigation inside PNTL has not started yet said a source close to the Investigation Commander unit in PNTL headquarter Dili. According to Tempo Semanal sources Mr. Jorge Monteiro, Commander of Internal Investigations, has yet to decide to investigate the suspended PNTL member.  Mr. Monteiro is himself a suspect in many previous cases of police misconduct.

When Tempo Semanal asked a PNTL officer from the Investigation Unit if a police suspect had fled to Indonesia he responded by saying that they could not find her.


The weapon is presumed to be with Timorese civilians but PNTL officers are blaming one another for the the weapon's loss due to competing interests among PNTL officers for the position of General Commander.

Tempo Semanal sources indicate that current Police Commissioner Longuinous Monteiro is viewed as being ineffective and incompetent by political leadership.

Presidential Statement Pledges to Make Annual Declarations of Assets

Office of President Matan Ruak issued a Presidential statement this afternoon on the matter of his declaration of personal assets:  Full text in Tetun, Portuguese and English below.

Meu querido povo de Timor-Leste,
Em 20 de Maio de 2012, tomei posse do cargo de Chefe de Estado da República Democrática de Timor- Leste.
Foi um momento em que você, o povo de Timor-Leste, confiou-me com poderes e privilégios para lhe servir. E com esses poderes e privilégios vêm com a maior e mais sério de responsabilidades.
Uma parte de minhas responsabilidades é que cumpra as promessas de minha campanha eleitoral. Um deles foi que eu tentar definir um exemplo de limpas e auto-disciplinados política em Timor-Leste.
A corrupção é lenta e insidiosamente infectando a nossa sociedade. Isso prejudica o nosso caráter moral e enfraquece as nossas instituições. Em uma época em que precisamos de mostrar disciplina para alcançar os objetivos nacionais de desenvolvimento não existe ameaça maior para nossos objetivos nacionais do que a busca da corrupção no interesse próprio.
Como Presidente, estou fazer uma declaração total e completa de meus bens pessoais totalmente público.
Faço isso para que o nosso povo possem saber quais os bens pessoais que possuo durante a minha Presidência e comprometo-me a fazer declarações anuais de activos até ao final do meu mandato. Faço isso para cumprir a minha promessa de levar por exemplo em nossa luta contra a corrupção.
O Gabinete do Presidente é um instituição público, que me têm sido confiadas com a executar um papel constitucional que é crítico para o funcionamento do Estado. O Instituição não é uma ferramenta para o meu enriquecimento pessoal.
Ao fazer esta declaração de meus bens pessoais e por meio de declarações anuais que devem, de acordo com as minhas responsabilidades de todos os cidadãos e a República Democrática de Timor-Leste, demonstrar que eu não e não vai usar a minha posição a enriquecer-me e a prática desses comportamentos corruptos.
No mato, falámos de um Timor livre da corrupção dos outros que vieram a regra sobre nós. Muitos timorenses derramaram seu sangue para este sonho.
Não podemos esquecer dos ideais patrióticos que nos guiou no passado. Eles agora são consumidos pelo vírus da corrupção.
Faço um apelo a todos os membros do governo, do parlamento nacional, os tribunais e todos os funcionários públicos a unir-se a mim a presente declaração plena e completa de bens pessoais anualmente.
Vamos todos ficar firmemente nesta luta para fazer um forte, livre e próspero Timor-Leste. Aqueles que optarem por não aderir a esta luta contra a corrupção devem perguntar a si mesmos se estão realmente aptos para serviço público. “E o povo de Timor-Leste que servimos todos os dias, são o juiz verdadeiro da credibilidade das pessoas em cargos públicos e no final o povo tomar a decisão final de nossos destinos.

My beloved People of Timor-Leste,
On 20 May 2012, I was sworn in as the Head State of the Democratic Republic of Timor-Leste.
It was a moment when you, the people of Timor-Leste, entrusted me with powers and privileges to serve you. And with these powers and privileges come with the highest and most serious of responsibilities.
Part of my responsibilities is that I fulfill the promises of my election campaign. One of these was that I seek to set an example of clean and self-disciplined politics in Timor-Leste.
Corruption is slowly and insidiously infecting our society. It undermines our moral character and weakens our institutions. In an era when we need to show discipline to achieve the national development goals there is no greater threat to our national objectives than the pursuit of corruption in the interest oneself.
As President, I am making a full and complete declaration of my personal assets totally public.
I do this so that people can know what personal assets I hold during my Presidency and I pledge to make annual declarations of assets until the end of my term in Office. I do this to fulfill my pledge to lead by example in our fight against corruption.
The Office of the President is a public office that I have been entrusted with to perform a constitutional role that is critical to the functioning of the State. The Office is not a tool for my own personal enrichment.
By making this declaration of my personal assets and through annual declarations I shall, in accordance with my responsibilities to all citizens and the Democratic Republic of Timor-Leste, demonstrate that I do not and will not use my position to enrich myself and to practise such corrupt behaviour.
In the jungle we used to talk of a Timor-Leste free of the corruption of others who have come to rule over us. Many Timorese shed their blood for this dream. We must not forget the patriotic ideals that guided us in the past. They are now consumed by the virus of corruption.
I call upon all members of government, national parliament, the courts and all public officials to join with me to present full and complete declaration of personal assets annually.
Let us all stand firmly in this fight to make a strong, free and prosperous Timor-Leste. Those who choose not to join in this struggle against corruption should ask themselves if they are truly fit for public office. It is the people of Timor-Leste, whom we serve every day, are the true judge of the credibility of those in public office and in the end our people make the final decision of our fates.
